"content": "\u003cp>Last month the Oakland Tribune and KCBS \u003ca href=\"http://ww2.kqed.org/news/2011/02/09/reports-no-charges-filed-against-police-who-shot-and-killed-derrick-jones/\">reported\u003c/a> that Alameda District Attorney Nancy O'Malley would not press charges against the two police officers involved in the \u003ca href=\"http://oaklandnorth.net/2010/11/09/east-oakland-barbershop-owner-shot-to-death-by-opd-officers/\">fatal shooting\u003c/a> of Derrick Jones last November. Today, the DA's office released its official report confirming that news. \u003c/p>\n\u003cp>Here's a PDF of the \u003ca href=\"http://ww2.kqed.org/news/wp-content/uploads/sites/10/2011/03/DERRICK-JONES.pdf\">\u003cstrong>full report\u003c/strong>\u003c/a>. \u003c/p>\n\u003cp>The document lays out the investigative steps taken by an Officer Involved Shooting Team and goes into the sequence of events leading up to the shooting, in which the two officers, Eriberto Perez-Angeles and Omar Daza-Quiroz, responding to a report of domestic violence by a woman on the street, fatally shot Jones after a pursuit. The officers said they thought the unarmed Jones had a gun. \u003c/p>\n\u003cp>The report also recaps the officers' statements as well as those of witnesses. \u003c!--more-->\u003c/p>\n\u003cp>Here is the report's final analysis and conclusion:\u003c/p>\n\u003cblockquote>\u003cp>\n\u003cem>ANALYSIS\u003c/em>\u003cbr>\nCalifornia law permits the use of deadly force in one’s own self defense if reasonably appears to the person claiming the right of self defense that he actually and reasonably believed that he was in imminent danger of great bodily injury or death. People v. Williams (1977) 75 Cal. App. 3d. 731. In protecting himself, a person may use all force, that he believes reasonably necessary and which would appear to a reasonable person, in the same or similar circumstances, to be necessary to prevent the injury, that appears to be imminent. This same principle applies when a person reasonably believes that great bodily injury or death is about to be inflicted upon another person to protect that individual from attack.\u003c/p>\n\u003cp>The killing of a human being at the hands of another is homicide and may be characterized as criminal, excusable or justifiable, depending on the circumstances. A homicide is justifiable if done in self-defense or defense of others, provided the actor actually and reasonably believed they or others were in imminent danger of great bodily injury or death. In protecting their own lives or the lives of others, a person may use all force he believes reasonably\u003cbr>\nnecessary to prevent imminent death or great bodily injury.\u003c/p>\n\u003cp>\u003cem>CONCLUSION\u003c/em>\u003cbr>\nThe OIS Team conducted a separate, albeit parallel, investigation and a thorough review of the facts and circumstances leading to the death of Mr. Derrick Jones. Allegations of misconduct are now commonplace, lawsuits have been filed, and the city manager and city attorney have been ousted. The dismissals, coupled with unfilled positions for fire chief, police chief, and economic development director, also have left a gaping hole in city leadership. Now, however, it turns out that at least part of that rumor is true: Russo applied for the Alameda job after the recruitment period opened Feb. 1.\u003c/p>\n\u003cp>The search for a new city manager is moving fast. More than 65 people applied for the job. The Alameda City Council interviewed six candidates and unanimously selected three finalists during a closed-door session Feb. 19. Jones did not respond to commands to halt, Israel said, and instead kept reaching for his waistband. At one point, he said, an officer saw an unspecified metal object in Jones’ hands before he looked over his shoulder toward the officers. The two officers then fired on Jones, Israel said, striking him multiple times. Jones was pronounced dead at the scene, and was unarmed but carrying a metal object, which Israel declined to identify. Jones did not respond to commands to halt, Israel said, and instead kept reaching for his waistband. At one point, he said, an officer saw an unspecified metal object in Jones’ hands before he looked over his shoulder toward the officers. The two officers then fired on Jones, Israel said, striking him multiple times. Jones was pronounced dead at the scene, and was unarmed but carrying a metal object, which Israel declined to identify.
