Toni Atkins will \u003ca href=\"https://www.kqed.org/news/11635564/state-senate-will-soon-have-its-first-woman-leader\" rel=\"noopener\" target=\"_blank\">make history\u003c/a> Wednesday when she becomes the first woman and first lesbian to hold the California Senate's top job.\u003c/p>\n\u003cp>A former Assembly speaker, Atkins is taking over the post of Senate president pro tem from fellow Democrat Kevin de Leon as the chamber gears up for election season and faces a number of thorny challenges, including a reckoning over sexual misconduct, a loss of the Democratic supermajority and an icy relationship with the state Assembly.\u003c/p>\n\u003cp>Atkins, whose colleagues describe her as measured, said she's not focused on making headlines.\u003c/p>\n\u003cp>\"I think you're going to see my focus will be internally so you're not going to get any big pronouncements,\" she said in a brief interview with The Associated Press.\u003c/p>\n\u003cp>Senate Democrats lost their supermajority last month when Los Angeles-area Sen. Tony Mendoza resigned rather than face an extremely rare expulsion vote over sexual misconduct allegations, and he's running again for the same seat. Sen. Josh Newman of Fullerton, meanwhile, is facing a recall that could cost the Democrats another seat in June.\u003c/p>\n\u003cp>[ad fullwidth]\u003c/p>\n\u003cp>On sexual misconduct, critics say the statehouse culture values the protection of lawmakers over justice for victims. Other efforts to put her stamp on the Senate, like reshuffling committee assignments, will come later, she said.\u003c/p>\n\u003cp>De Leon took control of the Senate in 2014. He's barred by term limits from seeking re-election and is challenging Democratic U.S. Sen. Scott Wiener, a San Francisco Democrat. \"People sometimes mistake that for weakness. But what they don't see is right underneath that surface is pure steel. She is tough as nails. But she has a huge heart.\"\u003c/p>\n\u003cp>Atkins, 55, is in her first four-year term as a senator after six years in the Assembly, where she also set a milestone as the first openly gay woman to serve as speaker. Wiener, who is gay, said having a member of the lesbian, gay, bisexual and transgender community in one of the state's most powerful positions will ensure that issues they face don't take a backseat now that same-sex marriage is legal.\u003c/p>\n\u003cp>Originally from Appalachian Virginia, Atkins moved west and was a health care administrator in San Diego before turning full time to politics.\u003c/p>\n\u003cp>\"San Diego, while the second-largest city in California, we're treated as if we're a backwater when it comes to funding and equal access,\" said Sen. Joel Anderson, a Republican who represents suburban and rural areas of San Diego County. \"Having a pro tem from Diego will give San Diego great gravitas in getting treated equally with all the other communities in California.\"\u003c/p>\n\u003cp>Last year, Atkins was a driving force behind a successful push to raise money for subsidized housing by charging $75 for many real-estate transactions. She also was the co-author of a contentious bill that would replace traditional health insurance companies with a single government-funded health care plan for everyone in the state.\u003c/p>\n\u003cp>She wrote a bill signed by Gov. Jerry Brown to create a \"non-binary\" gender option on driver's licenses for people who don't identify as male or female.\u003c/p>\n\u003cp>Sen. Pat Bates, a Republican from Laguna Niguel and the Senate minority leader, said she's hopeful Atkins will give Republicans more say in which committees they're assigned to and more notice before taking up legislation on the floor. The GOP, she said, is often left in the dark.\u003c/p>\n\u003cp>Sen. Tony Mendoza will learn next week whether he'll face formal disciplinary proceedings, the Senate Rules Committee said Friday, after receiving the results of an investigation into his behavior.\u003c/p>\n\u003cp>The findings of the investigation on Sen. Tony Mendoza have not been made public but were presented to the rules panel in a closed-door meeting. When it concluded, the five-member committee said it would decide Tuesday whether to recommend discipline, and if so will share the findings with all senators.\u003c/p>\n\u003cp>Mendoza, an Artesia Democrat, could be censured, suspended, expelled or face no discipline. Tony Mendoza (D-Artesia) to take a leave of absence while \u003ca href=\"http://www.sacbee.com/news/politics-government/capitol-alert/article185133028.html\">sexual harassment claims \u003c/a>against Mendoza are investigated.\u003c/p>\n\u003cp>De León says complaints of \u003ca href=\"http://www.sacbee.com/news/politics-government/capitol-alert/article189634769.html\">inappropriate touching\u003c/a> by Sen. Bob Hertzberg (D-Van Nuys) are also being investigated, though he did not ask Hertzberg to take a leave of absence.\u003c/p>\n\u003cp>\"Given the severity of the allegations against Sen. Mendoza, I do not believe he can perform (his) duties in Sacramento while the investigation is being conducted,\" de León says. \"I'm not prepared to say that about any other member right now.\"\u003c/p>\n\u003cp>Mendoza issued a statement this evening resisting de León's request.\u003c/p>\n\u003cp>\"I am very disappointed that certain Senate Rules Committee members are apparently asking me to take a leave of absence or resign before an investigation has even begun and without giving me an opportunity to defend myself, \" Mendoza said in a statement. He goes on to say he was not appointed to his position, but elected and he will vigorously defend himself.\u003c/p>\n\u003cp>[ad fullwidth]\u003c/p>\n\u003cp>The news came as California's Senate announced several reforms meant to better address sexual harassment claims in the chamber.\u003c/p>\n\u003cp>The Senate will begin working with a \u003ca href=\"https://www.weaveinc.org/\">rape crisis center\u003c/a> to counsel victims of sexual harassment and assault. It will provide a 24-hour confidential hotline (800-729-1443) for anyone to call if they have a sexual harassment complaint against someone who works for the Legislature. And two outside law firms were chosen to investigate those claims, California-based Gibson, Dunn & Crutcher and Sacramento-based Van Dermyden Maddux. The Gibson, Dunn team will be lead by former U.S. Attorney Benjamin Wagner.\u003c/p>\n\u003cp>[contextly_sidebar id=\"jxySytnZ1IwpWRqKkn9h2YJqjuLF0597\"]\u003c/p>\n\u003cp>Sen. Holly Mitchell (D-Los Angeles) was on the committee that chose the firms. And he says he’d like to see similar measures taken in the Assembly.\u003c/p>\n\u003cp>“This should be a bicameral approach,\" de León said. \"There should be uniformity across the board. It will provide a 24-hour confidential hotline (800-729-1443) for anyone to call if they have a sexual harassment complaint against someone who works for the Legislature. And two outside law firms were chosen to investigate those claims, California-based Gibson, Dunn & Crutcher and Sacramento-based Van Dermyden Maddux. The Gibson, Dunn team will be lead by former U.S. Attorney Benjamin Wagner.\u003c/p>\n\u003cp>\u003c/p>\u003cp>\u003c/p>\u003cp>\u003c/p>\n\u003cp>Sen. Holly Mitchell (D-Los Angeles) was on the committee that chose the firms. She says they will report the findings on the investigations they conduct to the Senate Rules Committee.\u003c/p>\n\u003cp>\"These attorneys who've been retained for a period of two years will work together to conduct thorough, independent and prompt investigations of allegations of misconduct,\" Mitchell says.\u003c/p>\n\u003cp>De León stressed that there needs to be a culture change within the Capitol. And he says he’d like to see similar measures taken in the Assembly.\u003c/p>\n\u003cp>“This should be a bicameral approach,\" de León said. \"There should be uniformity across the board.
