Police said he refused to leave the plane and then resisted officers when they tried to handcuff him. "content": "\u003cp>\u003cem>Update 12 p.m.\u003c/em> KQED's Mina Kim spoke to Donna Doyle, Deshon Marman's mother, about today's \u003ca href=\"http://ww2.kqed.org/news/2011/07/13/deshon-marman-wont-be-charged-in-saggy-pants-case/#end\">announcement\u003c/a> by the San Mateo County DA that there would no charges filed against her son in the sagging pants case. Listen below. An edited transcript follows the audio.\u003c/p>\n\u003cp>Also, here's an edited \u003ca href=\"http://ww2.kqed.org/news/2011/07/13/deshon-marman-wont-be-charged-in-saggy-pants-case/#transcript\">transcript\u003c/a> of an interview that KQED intern Erin Ferguson conducted with John McDonald, VP of Communications at US Airways, before the announcement that no charges would be filed. \u003c/p>\n\u003cp>McDonald was reacting to San Francisco Supervisor Malia Cohen's call for a board resolution in support of Marman, including a request that US Airways apologize. I'm glad they finally decided to do the right thing. \u003c/p>\n\u003cp>\u003cstrong>I understand you're considering pursuing legal action against the airline? \u003c/strong>\u003c/p>\n\u003cp>I haven't gone that far as of yet but at some point I will speak with my attorney and see what's the next step.\u003c/p>\n\u003cp>\u003cstrong>What would you be suing the airline for?\u003c/strong>\u003c/p>\n\u003cp>Well there's a lot of racism in there. Between the humiliation and the harassment that they brought upon my son. \u003c/p>\n\u003cp>\u003cstrong>Are you talking with the NAACP about their support? I know they spoke out strongly in support of Deshon.\u003c/strong>\u003c/p>\n\u003cp>Yes I have spoken with pastor (Amos) Brown last night when we heard the decsion and I'll be speaking with him again today at some point.\u003c/p>\n\u003cp>\u003cstrong>And right now are you in conversation with your lawyers to determine whether or not you \u003cem>want\u003c/em> to pursue the suit or \u003cem>how\u003c/em> to pursue it?\u003c/strong>\u003c/p>\n\u003cp>On how to pursue it and what measures we need to take to make it happen. \u003c/p>\n\u003cp>\u003cstrong>So you've already decided to go ahead and do it, it's just a matter of how you'll pursue it then? \u003c/strong>\u003c/p>\n\u003cp>Um, pretty much. Yes. Yes.\u003c/p>\n\u003cp>\u003c!--more-->\u003c/p>\n\u003cp>\u003cstrong>How is Deshon doing? What was his reaction to the news?\u003c/strong>\u003c/p>\n\u003cp>Deshon is overwhelmed but grateful that all this has come to an end. It took a toll on him after being humiliated and embarrassed nationwide. We're glad that it's come to an end. \u003c/p>\n\u003cp>\u003cstrong>Were you the one who gave him the news?\u003c/strong>\u003c/p>\n\u003cp>Yes I was. He jumped for joy. \"Yeah mom we did it. Tell everybody from home I love them and thank them for all the love and support.\" Because we had a lot of support around Deshon here that rallied yesterday afternoon at 12 o'clock at City Hall. It was beautiful. From the supervisor Malia Cohen to a few of the other supervisors in the city. Different communities that had gotten together and rallied around Deshon, so he was really excited and pleased.\u003c/p>\n\u003cp>\u003cstrong>Has he been a bit surprised by the national reaction to what happened? \u003c/strong>\u003c/p>\n\u003cp>I would think he would be surprised. You wouldn't think that because of saggy pajamas that this would go nationwide. And it kind of blew up. Being that it became a racist thing; you have other people that can wear what they want to wear on the plane, but here comes this African American kid that chooses to wear what he wants to and it becomes a problem. I think we all were pretty surprised.\u003c/p>\n\u003cp>\u003cstrong>What was the hardest part about this process for Deshon?\u003cbr>\n\u003c/strong>\u003c/p>\n\u003cp>The embarrassment, being taken off the plane. The police jumping on him and carrying him out of the airport in like a bodybag and people looking and seeing this go on.\u003c/p>\n\u003cp>\u003cstrong>What are you seeking from the airline? At the NAACP press conference, one of the things they were saying was that they wanted an apology from the airline and also senstivity training. The airline has not yet issued an apology and they're standing by their statement that he needed to obey crewmembers' instructions. What is your response to that?\u003c/strong>\u003c/p>\n\u003cp>First of all, the crewmembers shouldn't have been addressing Deshon any further when he complied and did what the young lady asked him to do, and that was to pull up his pants. It took a toll on him after being humiliated and embarrassed nationwide. We're glad that it's come to an end. \u003c/p>\n\u003cp>\u003cstrong>Were you the one who gave him the news?\u003c/strong>\u003c/p>\n\u003cp>Yes I was. He jumped for joy. \"Yeah mom we did it. Tell everybody from home I love them and thank them for all the love and support.\" Because we had a lot of support around Deshon here that rallied yesterday afternoon at 12 o'clock at City Hall. It was beautiful. From the supervisor Malia Cohen to a few of the other supervisors in the city. Different communities that had gotten together and rallied around Deshon, so he was really excited and pleased.\u003c/p>\n\u003cp>\u003cstrong>Has he been a bit surprised by the national reaction to what happened? \u003c/strong>\u003c/p>\n\u003cp>I would think he would be surprised. You wouldn't think that because of saggy pajamas that this would go nationwide. And it kind of blew up. Being that it became a racist thing; you have other people that can wear what they want to wear on the plane, but here comes this African American kid that chooses to wear what he wants to and it becomes a problem. I think we all were pretty surprised.\u003c/p>\n\u003cp>\u003cstrong>What was the hardest part about this process for Deshon?\u003cbr>\n\u003c/strong>\u003c/p>\n\u003cp>The embarrassment, being taken off the plane. The police jumping on him and carrying him out of the airport in like a bodybag and people looking and seeing this go on.\u003c/p>\n\u003cp>\u003cstrong>What are you seeking from the airline? At the NAACP press conference, one of the things they were saying was that they wanted an apology from the airline and also senstivity training. The airline has not yet issued an apology and they're standing by their statement that he needed to obey crewmembers' instructions. But that spot features only about a minute of Marman actually talking. Now, KGO has posted the \u003ca href=\"http://abclocal.go.com/kgo/video?id=8198074\">\u003cstrong>raw video\u003c/strong>\u003c/a> of the interview, which lasts nearly 18 minutes of Marman explaining exactly what happened, from his perspective. So as I was walking carrying my bags, I had a 12-pound duffel bag and a shoulder bag, and I was carrying my bags through the tunnel behind all the passengers, a ticket taker had followed me down the corridor and she asked me to pull up my pants. I acknowledged her, I said, ‘yes,” I had my (bag) in my hands…so I kind of jumped and tried to pull up my pajama pants, but like I said they were already set by a string so naturally they fell right back to the position. My pants were actually not below my knees, below my buttocks, they were slightly below my waist. But I was in pajama pants, flight clothes. Right as I entered the cabin, the ticket taker, she had went to a flight attendant…as I was taking my seat. So as I took my seat I put my bags away, I sat down, took my seat, and I was ready to go, I was ready to get on the flight. \u003c/p>\n\u003cp>The flight attendant came to me and asked me if I could step off the plane and go talk to the woman or address the situation. I was real tired, like I said, I was under heavy emotional distress, I’d just lost my best friend, and I was really ready to go back to school and get my life back where I had my plans. So I really didn’t feel like getting up, or I didn’t see the need to get up and leave my seat. I told that flight attendant I really don’t want to get up right now, I’m tired, my best friend had got killed, I just want to catch my flight and be on my way. \u003c/p>\n\u003cp>She had left, they had sent someone else to talk to me. I explained again, I didn’t want to get off the plane, I felt like I hadn’t done anything wrong. As I took my seat I pulled up my pajama bottoms and felt like everything was fine. So they sent the pilot and a couple of police officers and tried to ask me to leave the plane. The pilot came to me and the way he talked to me was not forthcoming. He was kind of belligerent, downtalking to me as if I was a child. He was like, ‘you’re gonna pull up your pants, we’re gonna ride on this flight and I’m not going to have any problems out of you.’\u003c/p>\n\u003cp>Tension had been building already, I tried to control myself with the captain. I said ‘yes sir, I’m in my seat, my pants are pulled up and we’re ready to go.’ And he had agreed..everything had calmed down. And one of the officers had asked me for my boarding pass. I stated, ‘I wouldn’t be on the plane, officer, if I didn’t have a boarding pass. I’m just like everybody else on this plane.’ I said I’m just like everybody else on this plane, I’m human. And the pilot said, ‘no you’re not, you’re not like everybody else.’ So you know, I’m just like, okay, I just sat back and let everything take its course-\u003c/p>\n\u003cp>\u003cem>What do you think he meant when he said that? \u003c/em>\u003c/p>\n\u003cp>I don’t’ know. I don’t know what he meant. Only the man who said it knows what he meant.\u003c/p>\n\u003cp>\u003cem>What went through your mind?\u003c/em>\u003c/p>\n\u003cp>You know, I was appalled, I was shocked. You know. But I really just-\u003c/p>\n\u003cp>\u003cem>You think he was making a racial slur at you?\u003c/em>\u003c/p>\n\u003cp>I’m not sure. I can’t tell you what the next man is thinking or saying. But he said it, it’s in the past, we’re trying to move forward and handle the situation. But after that, the officer had asked me for my boarding pass. I said, ‘officer, I wouldn’t be on the plane if I didn’t have a boarding pass. I don’t feel a need to show you my boarding pass.’ At that point in time I felt like I was being harassed. They had sent three people to come try to remove me off the plane. I felt like I didn’t do anything wrong, I felt like I paid for my ticket, I paid my fees, I went through the checkpoint and everything all right, security and everything all right. I feel like I didn’t do anything wrong. So why am I being asked to leave my seat, after I complied with the woman – you know I tried but I had my bags in my hand. \u003c/p>\n\u003cp>But after that whole incident they had sent a sheriff from San Mateo County to come talk to me. He was more forthcoming, he talked to me with a benevolent tone. So I could relate to him and talk to him. He asked me to step off the flight. Because they said they didn’t want me on the flight. I could understand after everything that happened. I said, ‘are you guys going to refund my flight so I can make it back to New Mexico?’ He said ‘yes, we’re going to refund your flight.’\u003c/p>\n\u003cp>So I had grabbed my bags off the plane after everybody was evacuated, I had stepped off the plane. As soon as I stepped off the plane an officer approached me and grabbed my wrist. I said ‘excuse me officer I’m not being arrested. You know, we’re walking up to the terminal so I can get on another flight.’ And he was like, ‘no we’re gonna walk you up in handcuffs.’ I ‘m like, ‘I didn’t do anything wrong, why are you arresting me?’ They never mirandized me, they never read me any rights, they never told me why I was being arrested. \u003c/p>\n\u003cp>So after he grabbed my wrist, I told him I didn’t do anything wrong. I had located the sheriff that had talked to me about walking off the plane. I said, ‘sheriff can I follow you up to the terminal?’ He said yes. As soon as I stepped to follow him, they grabbed my arm from behind me, I pulled my arm forward. You know, because anyone who didn’t commit a crime or felt like they didn’t’ do anything would resist arrest. They didn’t’ tell me why I was being arrested, they didn’t read me any rights, they just started grabbing me and putting me in handcuffs. They put me in leg restraints and a chest restraint, and they carried me down where the baggage carts are, and they detained me. \u003c/p>\n\u003cp>\u003cem>You know that they booked you on trespassing, that’s the charge? \u003c/em>\u003c/p>\n\u003cp>I don’t’ see how they book me on trespassing when I’m a paying customer.\u003c/p>\n\u003c/blockquote>\n\u003cp>Marman then spoke about his feelings about sagging pants and his belief that his pants were not unreasonably hanging down. He denied that any of his private parts were showing. But that spot features only about a minute of Marman actually talking. Now, KGO has posted the \u003ca href=\"http://abclocal.go.com/kgo/video?id=8198074\">\u003cstrong>raw video\u003c/strong>\u003c/a> of the interview, which lasts nearly 18 minutes of Marman explaining exactly what happened, from his perspective. "content": "\u003cp>KQED reporter Mina Kim today spoke with San Mateo County Chief Deputy DA Stephen Wagstaffe about the DeShon Marman case. Marman, a graduate of Lincoln High in San Francisco, is the 20-year-old college football player who was \u003ca href=\"http://www.sfgate.com/cgi-bin/article.cgi?f=/c/a/2011/06/17/BA5F1JV3LJ.DTL\">removed\u003c/a> from a US Airways flight at SFO because he allegedly ignored an airline employee's request to pull up sweatpants hanging low enough to expose his underwear.\u003c/p>\n\u003cp>Chief Deputy DA Wagstaffe explained that Marman has not yet been charged with any crime and that prosecutors will be reviewing the case between now and the July 18 arraignment. He said his office had asked for additional accounts of the incident from airline personnel and passengers.\u003c/p>\n\u003cp>Police took Marman into custody on suspicion of three crimes: battery on a police officer, a felony, and resisting arrest and trespassing, both misdemeanors. He faces up to four years in state prison on the battery charge, and one year and six months, respectively, in a county jail for resisting arrest and trespassing. \u003c!--more-->\u003c/p>\n\u003cp>Wagstaffe said he had seen cases arising from confrontations at security checkpoints, but couldn't remember ever prosecuting one stemming from a problem on the plane itself.\u003c/p>\n\u003cp>Interestingly enough, at the end of the interview, the chief deputy DA volunteered the following:\u003c/p>\n\u003cblockquote>\u003cp>\"We're not deciding how somebody wears their clothing is a crime. Because it's not. What we're deciding is whether or not there was an interaction that occurred (where) there was conduct by Mr. Marman that violated the laws in his dealing with the police and with the personnel there. That's what we're looking at. This has nothing to do with whether it's inappropriate for somebody to wear their clothing in a certain way.
