I was troubled by the shooting in Oakland in particular. What made me align with the angry commuters was the recent gay-baiting sexual terrorist type tactics that were used against BART spokesperson Linton Johnson. \u003c/p>\n\u003cp>\u003cstrong>What was your reaction when you saw that?\u003c/strong>\u003c/p>\n\u003cp>I think a lot of us in the gay community thought of it as a declaration of war against us. A lot of us had really been ambivalent at best about the protest. Or supported the protest. But when they came out and used the tactics of right wingers like Andrew Breitbart or Karl Rove or something we were just shocked. This is San Francisco. What they were trying to do was delegitimize this man for being gay. Very few of the photos were sexually explicit, most of them were of him clowning around at a gay bar with glow sticks or glitter, hanging on guys. And then they promoted his personal web site, which had his gay marriage photos and vacation pictures. This had nothing to do with anything. \u003c/p>\n\u003cp>But if their goal was not to discredit him for merely being gay, then what was that? It's obvious that's what they were doing.\u003c/p>\n\u003cp>\u003cstrong>Are you planning on taking part in a \u003ca href=\"http://www.baycitizen.org/bart-police-shooting/story/commuters-plan-protest-bart-protest/\">counter protest\u003c/a> on Monday?\u003c/strong>\u003c/p>\n\u003cp>I am and I know a lot of others in the community that will be joining me out there. These tactics have basically swung many in the community to the other side. We're outraged that in this enlightened city this is the tactic they decided to take. \u003c/p>\n\u003cp>\u003cstrong>Are you helping to organize the protest? \u003c/strong>\u003c/p>\n\u003cp>The protest was already planned by the commuters' group. What I'm doing is helping to organize the LGBT community to join with that group.\u003c/p>\n\u003cp>\u003cstrong>How many people so far who share your view may be out there with you? \u003c/strong>\u003c/p>\n\u003cp>I think there's going to be a significant number. This just happened. Wednesday was the shot across the bow that took us all by surprise so I don't know how many we're going to get this first time. But the tide has strongly shifted. Just from a tactical perspective, this was a monumental error for them to take this kind of approach in targeting someone the way they targeted Mr. Johnson.\u003c/p>\n\u003cp>\u003cstrong>Are you concerned about reprisals from Anonymous? \u003c/strong>\u003c/p>\n\u003cp>Absolutely, I think there's a strong risk. They obviously have no scruples, so yes; I do realize that I'm putting myself at risk to be hacked. They are masked – that's their whole point, that they're operating in secret. So it is very dangerous to oppose them; I feel most people do understand that so I don't know how that will affect turnout. \u003c/p>\n\u003cp>\u003cstrong>But you are wiling to take that risk…\u003c/strong>\u003c/p>\n\u003cp>I feel like it's absolutely necessary. The people have got to stand up to this. I was outraged with the Anthony Wiener thing that happened. I'm outraged when the right wing does this and I'm outraged when these far left protesters do it. I think it's the wrong way to go about things, to single out an individual and try to destroy them based on sexual orientation using gay baiting tactics or sexual terrorism. It's a bizarre approach for them to take. But when those types of things happen, especially in this world-class city we live in, we have to take a stand against it. \u003c/p>\n\u003c/blockquote>\n\n",

What made me align with the angry commuters was the recent gay-baiting sexual terrorist type tactics that were used against BART spokesperson Linton Johnson. \u003c/p>\n\u003cp>\u003cstrong>What was your reaction when you saw that?\u003c/strong>\u003c/p>\n\u003cp>I think a lot of us in the gay community thought of it as a declaration of war against us. A lot of us had really been ambivalent at best about the protest. Or supported the protest. But when they came out and used the tactics of right wingers like Andrew Breitbart or Karl Rove or something we were just shocked. This is San Francisco. What they were trying to do was delegitimize this man for being gay. Very few of the photos were sexually explicit, most of them were of him clowning around at a gay bar with glow sticks or glitter, hanging on guys. And then they promoted his personal web site, which had his gay marriage photos and vacation pictures. This had nothing to do with anything. \u003c/p>\n\u003cp>But if their goal was not to discredit him for merely being gay, then what was that? It's obvious that's what they were doing.\u003c/p>\n\u003cp>\u003cstrong>Are you planning on taking part in a \u003ca href=\"http://www.baycitizen.org/bart-police-shooting/story/commuters-plan-protest-bart-protest/\">counter protest\u003c/a> on Monday?\u003c/strong>\u003c/p>\n\u003cp>I am and I know a lot of others in the community that will be joining me out there. These tactics have basically swung many in the community to the other side. We're outraged that in this enlightened city this is the tactic they decided to take. \u003c/p>\n\u003cp>\u003cstrong>Are you helping to organize the protest? \u003c/strong>\u003c/p>\n\u003cp>The protest was already planned by the commuters' group. What I'm doing is helping to organize the LGBT community to join with that group.\u003c/p>\n\u003cp>\u003cstrong>How many people so far who share your view may be out there with you? \u003c/strong>\u003c/p>\n\u003cp>I think there's going to be a significant number. This just happened. Wednesday was the shot across the bow that took us all by surprise so I don't know how many we're going to get this first time. But the tide has strongly shifted. Just from a tactical perspective, this was a monumental error for them to take this kind of approach in targeting someone the way they targeted Mr. Johnson.\u003c/p>\n\u003cp>\u003cstrong>Are you concerned about reprisals from Anonymous? \u003c/strong>\u003c/p>\n\u003cp>Absolutely, I think there's a strong risk. They obviously have no scruples, so yes; I do realize that I'm putting myself at risk to be hacked. They are masked – that's their whole point, that they're operating in secret. So it is very dangerous to oppose them; I feel most people do understand that so I don't know how that will affect turnout. \u003c/p>\n\u003cp>\u003cstrong>But you are wiling to take that risk…\u003c/strong>\u003c/p>\n\u003cp>I feel like it's absolutely necessary. The people have got to stand up to this. I was outraged with the Anthony Wiener thing that happened. I'm outraged when the right wing does this and I'm outraged when these far left protesters do it. I think it's the wrong way to go about things, to single out an individual and try to destroy them based on sexual orientation using gay baiting tactics or sexual terrorism. It's a bizarre approach for them to take. But when those types of things happen, especially in this world-class city we live in, we have to take a stand against it. \u003c/p>\n\u003c/blockquote>\n\n\u003c/div>\u003c/p>",

Board members receive a list of contractors who are subject to the limit each week. Kal Krishnan Consulting Services was on the list in February when it gave $7,000 to Fang. In an apparent loophole in the regulations, two other BART directors each received the maximum $1,000 from the same company and an additional $1,250 from staff and relatives of the owner last year. \u003c!--more-->\u003c/p>\n\u003cp>Fang said he thought Kal Krishnan – a longtime BART contractor – did not have pending business when he gave the money. It is entirely staff,” he said. “It’s a very rigorous process.” \u003c!--more-->\u003c/p>\n\u003cp>Krishnan said his contributions constitute “free speech.”\u003c/p>\n\u003cp>“All these limitations are all unconstitutional and illegal,” he said. “We have the right to free speech in America. Are you working against that?”\u003c/p>\n\u003cp>BART Director Lynette Sweet said the board should go back to a previous policy banning campaign contributions from contractors.\u003c/p>\n\u003cp>“When you’re giving to the same directors who keep voting to give you contracts over and over, it just doesn’t look good,” she said.\u003c/p>\n\u003cp>The board banned contractor money in 1996 in the wake of a bribery scandal. One former BART director pleaded guilty to accepting bribes; another pleaded guilty to lying to FBI agents. The bribes involved were as small as $1,000.\u003c/p>\n\u003cp>Then, in 2007, BART directors including Fang loosened the rules to allow contributions of up to $1,000 from contractors with pending bids. BART’s nine directors serve four-year terms.\u003c/p>\n\u003cp>In February 2010, when Krishnan had pending business with the board, the contractor hosted a fundraiser for two BART directors up for re-election, Thomas Blalock and Joel Keller.\u003c/p>\n\u003cp>“He had a little gathering … and got consultants together to honor us and toss some money into the pot, which is a typical thing they do,” Blalock said. “He even brought in some of his people from Southern California.”\u003c/p>\n\u003cp>Several other contractors gave money, but Krishnan showed them up. Krishnan’s company gave $1,000 to both Blalock and Keller. Each director also received another $500 from Krishnan and his wife; $500 from a company manager named Dev Krishnan, and $250 from another employee.\u003c/p>\n\u003cp>The extra $1,250 Blalock and Keller received came from individuals, not the company’s account, so it shouldn’t count toward the $1,000 limit, Blalock said. Aside from the contractor regulation, there are no limits on BART campaign contributions. Blalock noted that the rules are “not as tough anymore.”\u003c/p>\n\u003cp>“I’ve taken a more relaxed attitude about it also,” he said. “I don’t think we’ve crossed the line anywhere.”\u003c/p>\n\u003cp>Blalock said the money doesn’t influence his votes.\u003c/p>\n\u003cp>Krishnan, whose office is across the hall from the BART boardroom in Oakland, said, “My friends need to have some money.”\u003c/p>\n\u003cp>“Political campaigns are expensive, they need money and these people do very good work,” he said.\u003c/p>\n\u003cp>Keller, who led the charge to loosen contribution rules in 2007, did not return phone calls.\u003c/p>\n\u003cp>On Aug. 11, Keller, Blalock and Fang voted with the board majority to give Krishnan’s company and two others engineering contracts worth up to $20 million for each company over five years. Krishnan’s firm is a general engineering contractor.\u003c/p>\n\u003cp>Krishnan had received an award in 2009 for $15 million over five years, but the money has been used up early. Sweet, upset at how quickly the last award had been spent, was the only director to vote against the new awards.\u003c/p>\n\u003cp>Two unions representing BART employees opposed the new contracts, arguing that BART staff could do some of the work that was being contracted out. One of the unions, Service Employees International Union Local 1021, gave Fang $7,500 in Februrary.\u003c/p>\n\u003cp>But Fang said at the meeting that he supported the contracts, in part because the companies are led by minorities.\u003c/p>\n\u003cp>“You have basic firms, people of color, taking the principal role,” he said. “And that’s what, without getting too corny, that’s what America is about. So I plan to move forward and support this.”\u003c/p>\n\u003cp>In a separate decision earlier this year, Fang pushed for the board to negotiate a real estate deal with a longtime friend, developer Lawrence Lui. As previously reported, Lui had given Fang $3,500 last year. BART’s campaign contribution rules refer to contractors, not developers.\u003c/p>\n\u003cp>Michael Van Every, senior vice president at Republic Urban Properties, which had a competing development proposal, called the campaign contributions “completely ethically wrong.”\u003c/p>\n\u003cp>“I think the BART conflict of interest laws are a joke,” he said.\u003c/p>\n\u003cp>Fang said the money didn’t influence him and pointed out that Republic Urban had hired a lobbyist to push its proposal. He said Lui has “been giving me money for like 20 years.”\u003c/p>\n\u003cp>“Because we’re both Chinese, people are focusing in on this quote ‘relationship,’ and I think that’s very unfair,” he said. “Why all this attention on this poor Chinese guy? We didn’t even award him anything. Are you working against that?”\u003c/p>\n\u003cp>BART Director Lynette Sweet said the board should go back to a previous policy banning campaign contributions from contractors.\u003c/p>\n\u003cp>“When you’re giving to the same directors who keep voting to give you contracts over and over, it just doesn’t look good,” she said.\u003c/p>\n\u003cp>The board banned contractor money in 1996 in the wake of a bribery scandal. One former BART director pleaded guilty to accepting bribes; another pleaded guilty to lying to FBI agents. The bribes involved were as small as $1,000.\u003c/p>\n\u003cp>Then, in 2007, BART directors including Fang loosened the rules to allow contributions of up to $1,000 from contractors with pending bids. BART’s nine directors serve four-year terms.\u003c/p>\n\u003cp>In February 2010, when Krishnan had pending business with the board, the contractor hosted a fundraiser for two BART directors up for re-election, Thomas Blalock and Joel Keller.\u003c/p>\n\u003cp>“He had a little gathering … and got consultants together to honor us and toss some money into the pot, which is a typical thing they do,” Blalock said. “He even brought in some of his people from Southern California.”\u003c/p>\n\u003cp>Several other contractors gave money, but Krishnan showed them up. Krishnan’s company gave $1,000 to both Blalock and Keller. Each director also received another $500 from Krishnan and his wife; $500 from a company manager named Dev Krishnan, and $250 from another employee.\u003c/p>\n\u003cp>The extra $1,250 Blalock and Keller received came from individuals, not the company’s account, so it shouldn’t count toward the $1,000 limit, Blalock said. Aside from the contractor regulation, there are no limits on BART campaign contributions. Blalock noted that the rules are “not as tough anymore.”\u003c/p>\n\u003cp>“I’ve taken a more relaxed attitude about it also,” he said. “I don’t think we’ve crossed the line anywhere.”\u003c/p>\n\u003cp>Blalock said the money doesn’t influence his votes.\u003c/p>\n\u003cp>Krishnan, whose office is across the hall from the BART boardroom in Oakland, said, “My friends need to have some money.”\u003c/p>\n\u003cp>“Political campaigns are expensive, they need money and these people do very good work,” he said.\u003c/p>\n\u003cp>Keller, who led the charge to loosen contribution rules in 2007, did not return phone calls.\u003c/p>\n\u003cp>On Aug. 11, Keller, Blalock and Fang voted with the board majority to give Krishnan’s company and two others engineering contracts worth up to $20 million for each company over five years. Krishnan’s firm is a general engineering contractor.\u003c/p>\n\u003cp>Krishnan had received an award in 2009 for $15 million over five years, but the money has been used up early. Sweet, upset at how quickly the last award had been spent, was the only director to vote against the new awards.\u003c/p>\n\u003cp>Two unions representing BART employees opposed the new contracts, arguing that BART staff could do some of the work that was being contracted out. One of the unions, Service Employees International Union Local 1021, gave Fang $7,500 in Februrary.\u003c/p>\n\u003cp>But Fang said at the meeting that he supported the contracts, in part because the companies are led by minorities.\u003c/p>\n\u003cp>“You have basic firms, people of color, taking the principal role,” he said. “And that’s what, without getting too corny, that’s what America is about. So I plan to move forward and support this.”\u003c/p>\n\u003cp>In a separate decision earlier this year, Fang pushed for the board to negotiate a real estate deal with a longtime friend, developer Lawrence Lui. As previously reported, Lui had given Fang $3,500 last year. BART’s campaign contribution rules refer to contractors, not developers.\u003c/p>\n\u003cp>Michael Van Every, senior vice president at Republic Urban Properties, which had a competing development proposal, called the campaign contributions “completely ethically wrong.”\u003c/p>\n\u003cp>“I think the BART conflict of interest laws are a joke,” he said.\u003c/p>\n\u003cp>Fang said the money didn’t influence him and pointed out that Republic Urban had hired a lobbyist to push its proposal. He said Lui has “been giving me money for like 20 years.”\u003c/p>\n\u003cp>“Because we’re both Chinese, people are focusing in on this quote ‘relationship,’ and I think that’s very unfair,” he said. “Why all this attention on this poor Chinese guy? We didn’t even award him anything. People are organizing around this issue and it's a legitimate issue to organize around. It's an inconvenience for protesters to protest. We are all BART passengers, we all have lives, we all haves jobs. We don't want to be protesting. We're doing it because we feel a moral imperative to do something about a situation that's literally a health and safety hazard for the public. BART decided to take on Anonymous for some reason. They decided to do the cell phone shutdown. People responded all over the world. I don't think they expected it; I certainly didn't expect this kind of a response to what BART did. But they got themselves into this and Anonymous responded.\u003c/p>\n\u003cp>And BART's response to this crisis is the same as it has been in every situation. They try to duck responsibility and they dig themselves in further. They could have defused the entire situation by saying it was a mistake, it didn't work, it won't work in the future and we're never going to do it again. "content": "\u003cp>The BART Board of Directors held a special meeting yesterday to discuss the controversial shutdown of its wireless service on Aug 11, an action it took to disrupt a planned protest that was organized online. \u003c/p>\n\u003cp>The action touched off a \u003ca href=\"http://ww2.kqed.org/news/2011/08/16/audio-barts-shutdown-of-cell-phone-service-two-legal-opinions-lynette-sweet/\">debate\u003c/a> as to the legality of BART's action, and angered activists that have targeted the transit agency because of the July shooting death of Charles Hill by a BART police officer. In relatiation, computer hackers, working under the banner of a \u003ca href=\"http://ww2.kqed.org/news/2011/08/18/so-what-exactly-is-anonymous-anyway/\">loosely knit\u003c/a> group called Anonymous, broke into BART-related web sites, releasing the private information of customers and BART police officers. In addition, a series of protests called for by the group online have disrupted train service as BART closed down certain stations during evening commutes. Forty-five people were \u003ca href=\"http://abclocal.go.com/kgo/story?section=news/local/san_francisco&id=8319733\">arrested\u003c/a> during the latest action on Monday.\u003c/p>\n\u003cp>The upshot of yesterday's BART board meeting from the \u003ca href=\"http://www.sfgate.com/cgi-bin/article.cgi?f=/c/a/2011/08/25/BA3C1KRINF.DTL\">\u003cstrong>Chronicle\u003c/strong>\u003c/a>: \u003c/p>\n\u003cblockquote>\u003cp>BART directors, slammed with criticism over the transit system's decision to shut down underground wireless service to stop a demonstration, agreed Wednesday they should limit use of that tactic to extreme situations in which public safety is endangered.\u003c/p>\n\u003cp>The BART Board of Directors, at a special meeting called to discuss the controversial wireless shutdown, did not vote on a policy, citing state open meeting laws. In relatiation, computer hackers, working under the banner of a \u003ca href=\"http://ww2.kqed.org/news/2011/08/18/so-what-exactly-is-anonymous-anyway/\">loosely knit\u003c/a> group called Anonymous, broke into BART-related web sites, releasing the private information of customers and BART police officers. In addition, a series of protests called for by the group online have disrupted train service as BART closed down certain stations during evening commutes. Forty-five people were \u003ca href=\"http://abclocal.go.com/kgo/story?section=news/local/san_francisco&id=8319733\">arrested\u003c/a> during the latest action on Monday.\u003c/p>\n\u003cp>The upshot of yesterday's BART board meeting from the \u003ca href=\"http://www.sfgate.com/cgi-bin/article.cgi?f=/c/a/2011/08/25/BA3C1KRINF.DTL\">\u003cstrong>Chronicle\u003c/strong>\u003c/a>: \u003c/p>\n\u003cblockquote>\u003cp>BART directors, slammed with criticism over the transit system's decision to shut down underground wireless service to stop a demonstration, agreed Wednesday they should limit use of that tactic to extreme situations in which public safety is endangered.\u003c/p>\n\u003cp>The BART Board of Directors, at a special meeting called to discuss the controversial wireless shutdown, did not vote on a policy, citing state open meeting laws.
