Once again the Supreme Court is siding with corporate America and Walmart against our children. I think the saving grace in the decision is that there were a number of dissenting opinions. Breyer, Alito, Kennedy...\u003c/p>\n\u003cp>But what the court missed is the fact that these ultra-violent video games are different technology than books, and it has a different effect on our children. It is not passive looking and passive reading of material. It's actively doing things and changing your brain connection, changing your behavior, and that's what is particularly harmful to our children. \u003c/p>\n\u003c/blockquote>\n\u003cp>\u003c!--more-->\u003c/p>\n\u003cp>[ad fullwidth]\u003c/p>\n\u003cp>And this...\u003c/p>\n\u003cblockquote>\u003cp>One of the difficulties in terms of parents: We will never know the full extent of the cruelty and the violence in any of these games, because you have to be sophisticated enough to open the game into those higher levels of violence. \u003c/p>\n\u003caside class=\"pullquote alignleft\">Within a game are embedded different levels of violence and it's only if you are sophisticated enough to do the low-level violence that you get to experience the high-level violence. \u003c/aside>\n\u003cp>As a result, many parents will not know what they're kids are playing. This is different than a movie. You watch a movie for two hours and you see everything. Within a game are embedded different levels of violence and it's only if you are sophisticated enough to do the low-level violence that you get to experience the high-level violence. \u003c/p>\n\u003cp>For many parents who are not that sophisticated in this technology, you'll never get to that higher level and therefore you'll never know what kinds of activities your kids are engaged in…\u003c/p>\n\u003c/blockquote>\n\u003cp>Lee also appeared on KQED Radio's Forum program today, along with a senior vice president of communications and industry affairs for the Electronic Software Association. \u003ca href=\"http://www.kqed.org/a/forum/R201106271000\">LISTEN HERE\u003c/a>.\u003c/p>\n\u003cp>\u003c!--more-->\u003c/p>\n\u003cp>Here's the AP article on today's ruling:\u003c/p>\n\u003cp>\u003ca name=\"news\">WASHINGTON (AP) – WASHINGTON – The Supreme Court on Monday refused to let California regulate the sale or rental of violent video games to children, saying governments do not have the power to \"restrict the ideas to which children may be exposed\" despite complaints about graphic violence.\u003c/a>\u003c/p>\n\u003cp>On a 7-2 vote, the high court upheld a federal appeals court decision to throw out the state's ban on the sale or rental of violent video games to minors. The 9th U.S. Circuit Court of Appeals in Sacramento had ruled that the law violated minors' rights under the First Amendment, and the high court agreed.\u003c/p>\n\u003cp>\"No doubt a state possesses legitimate power to protect children from harm,\" said Justice Antonin Scalia, who wrote the majority opinion. \"But that does not include a free-floating power to restrict the ideas to which children may be exposed.\"\u003c/p>\n\u003cp>The California law would have prohibited the sale or rental of violent games to anyone under 18. Retailers who violated the act would have been fined up to $1,000 for each infraction.\u003c/p>\n\u003cp>More than 46 million American households have at least one video-game system, with the industry bringing in at least $18 billion in 2010.\u003c/p>\n\u003cp>Unlike depictions of \"sexual conduct,\" Scalia said there is no tradition in the United States of restricting children's access to depictions of violence, pointing out the violence in the original depiction of many popular children's fairy tales like Hansel and Gretel, Cinderella and Snow White.\u003c/p>\n\u003cp>Hansel and Gretel kill their captor by baking her in an oven, Cinderella's evil stepsisters have their eyes pecked out by doves and the evil queen in Snow White is forced to wear red hot slippers and dance until she is dead, Scalia said.\u003c/p>\n\u003cp>\"Certainly the books we give children to read — or read to them when they are younger — contain no shortage of gore,\" Scalia added.\u003c/p>\n\u003cp>But Justice Clarence Thomas, who dissented from the decision along with Justice Stephen Breyer, said the majority read something into the First Amendment that isn't there.\u003c/p>\n\u003cp>\"The practices and beliefs of the founding generation establish that \"the freedom of speech,\" as originally understood, does not include a right to speak to minors (or a right of minors to access speech) without going through the minors' parents or guardians,\" Thomas wrote.\u003c/p>\n\u003cp>The law was written by \u003ca href=\"http://dist08.casen.govoffice.com/index.asp?Type=B_PR&SEC=%7BEFA496BC-EDC8-4E38-9CC7-68D37AC03DFF%7D&DE=%7BEDF8FFFC-E59F-48D6-9C59-7E2B4345D18D%7D\">State Sen. The 9th U.S. Circuit Court of Appeals in Sacramento had ruled that the law violated minors' rights under the First Amendment, and the high court agreed.\u003c/p>\n\u003cp>\"No doubt a state possesses legitimate power to protect children from harm,\" said Justice Antonin Scalia, who wrote the majority opinion. \"But that does not include a free-floating power to restrict the ideas to which children may be exposed.\"\u003c/p>\n\u003cp>The California law would have prohibited the sale or rental of violent games to anyone under 18. "content": "\u003cp>Donna Doyle, the mother of “baggy pants” arrestee Deshon Marman, appeared today with members of the NAACP at the Third Baptist Church in San Francisco. Doyle and Amos Brown, president of the NAACP’s San Francisco chapter, spoke about the case at a press conference. \u003c/p>\n\u003cp>Doyle put the blame for the incident on US Airways, the airline that her 20-year-old son, a University of New Mexico football player, was removed from in a conflict over his pants. The pants, which Marman says were pajamas, were allegedly hanging low enough to expose his underwear. Marman was arrested on suspicion of battery on a police officer, resisting arrest, and trespassing, but the San Mateo County DA is still deciding whether to charge him. \u003c/p>\n\u003cp>Brown said that Marman was a victim of racial profiling and called for the airline to put its employees through sensitivity training. \u003c!--more-->\u003c/p>\n\u003cp>Both Doyle and Brown cited the \u003ca href=\"http://ww2.kqed.org/news/2011/06/22/us-airways-passenger-wearing-womens-underwear/\">cross-dressing frequent US Airways flyer\u003c/a> who has attracted attention over the past few days as evidence of a double standard by the airline.\u003c/p>\n\u003cp>Here is audio of some of Brown and Doyle’s comments, followed by an edited transcript. If they didn’t make an issue over (the man who flies US Airways in exposed panties). And you don’t single people out, and that’s what it ends up being. He was singled out. This man here should have been singled out if you’re going to be consistent to be dealt with.\u003c/p>\n\u003caside class=\"pullquote alignleft\">It was a question of walking while black, with some pants down.\u003c/aside>\n\u003cp>They initiated the atmosphere, they created the drama, and then they didn’t assume responsibility for the drama they created. You don’t go around subjectively dealing with people that way. That’s where racism comes in. Any time you deal with people in a manner before getting to know them. Nothing was done to talk to this yong man, to get to know him. \u003c/p>\n\u003cp>The main thing that happened here was you had a ticket agent who didn’t like the way he looked, and because she didn’t like the way he looked, she went after him. He hadn’t done anything, he hadn’t touched anybody, he hadn’t cursed anybody out. He hadn’t said a word. She just didn’t like the way he looked. So it was a question of walking while black, with some pants down. \u003c/p>\n\u003cp>\u003cem>Donna Doyle, mother of Deshon Marman\u003c/em>\u003c/p>\n\u003cp>You know I said I wasn’t going to say anything. But the whole thing began with the ticket agent, and like Reverend Brown stated, it started with the ticket agent not liking the way my son looked. When it went to the stewardess and the flight attendant, the flight attendant I feel, should have defused it… If he did have his underwear showing, you no longer saw them because his behind was in the seat. So at that point he became no longer a threat to anyone, because his butt was down. \u003c/p>\n\u003cp>The captain took it upon himself to come down the aisle out of his cabin to address the matter, not to defuse it, to address it and escalate. He escalated this drama. If you listen to the young man’s tape that recorded it, my son stated I don’t know how many times, “no sir, I’m sitting sir. Sir I didn’t do anything. Sir I’m like everyone else.” “No you’re not like everyone else.” Well what does he mean? I don’t’ know. What does he mean you’re not like everyone else? \u003c/p>\n\u003cp>So I truly feel had the pilot defused it, we wouldn’t be here today. He added to all of this. There was a sheriff there that stated that Deshon was not disrespectful. He wasn’t defiant in any way. \u003c/p>\n\u003cp>The saggy pants itself — I’m a mother of four sons, I don’t approve of it. They’re boys, it’s a trend. But these clothes are marketed. These people are making big money off these children. And then you turn around and not only criminalize the African American with these clothes, but you have to remember, we’re not the only ones who wear them. You have the Asians that wear them, you have the white boys that wear them, you have the Latinos and the rest of them that wear them. But you don’t go after these children like you’ve gone after our children. And that needs to stop. You don’t judge a book by its cover and that’s what they did. They judged my son by his attire of what he wore and that was unacceptable.\n\u003c/p>\u003c/blockquote>\n\u003cp>Here, Donna Doyle says she doesn’t condone her son’s attire, but that it’s his choice. Nothing was done to talk to this yong man, to get to know him. \u003c/p>\n\u003cp>The main thing that happened here was you had a ticket agent who didn’t like the way he looked, and because she didn’t like the way he looked, she went after him. He hadn’t done anything, he hadn’t touched anybody, he hadn’t cursed anybody out. He hadn’t said a word. She just didn’t like the way he looked. But the whole thing began with the ticket agent, and like Reverend Brown stated, it started with the ticket agent not liking the way my son looked. When it went to the stewardess and the flight attendant, the flight attendant I feel, should have defused it… If he did have his underwear showing, you no longer saw them because his behind was in the seat. So at that point he became no longer a threat to anyone, because his butt was down. \u003c/p>\n\u003cp>The captain took it upon himself to come down the aisle out of his cabin to address the matter, not to defuse it, to address it and escalate. He escalated this drama. If you listen to the young man’s tape that recorded it, my son stated I don’t know how many times, “no sir, I’m sitting sir. Sir I didn’t do anything. Sir I’m like everyone else.” “No you’re not like everyone else.” Well what does he mean? I don’t’ know. What does he mean you’re not like everyone else? \u003c/p>\n\u003cp>So I truly feel had the pilot defused it, we wouldn’t be here today. He added to all of this. There was a sheriff there that stated that Deshon was not disrespectful. He wasn’t defiant in any way. \u003c/p>\n\u003cp>The saggy pants itself — I’m a mother of four sons, I don’t approve of it. They’re boys, it’s a trend. But these clothes are marketed. These people are making big money off these children. And then you turn around and not only criminalize the African American with these clothes, but you have to remember, we’re not the only ones who wear them. You have the Asians that wear them, you have the white boys that wear them, you have the Latinos and the rest of them that wear them. But you don’t go after these children like you’ve gone after our children. And that needs to stop. You don’t judge a book by its cover and that’s what they did. I told that flight attendant I really don’t want to get up right now, I’m tired, my best friend had got killed, I just want to catch my flight and be on my way. \u003c/p>\n\u003cp>She had left, they had sent someone else to talk to me. I explained again, I didn’t want to get off the plane, I felt like I hadn’t done anything wrong. As I took my seat I pulled up my pajama bottoms and felt like everything was fine. So they sent the pilot and a couple of police officers and tried to ask me to leave the plane. The pilot came to me and the way he talked to me was not forthcoming. He was kind of belligerent, downtalking to me as if I was a child. He was like, ‘you’re gonna pull up your pants, we’re gonna ride on this flight and I’m not going to have any problems out of you.’\u003c/p>\n\u003cp>Tension had been building already, I tried to control myself with the captain. I said ‘yes sir, I’m in my seat, my pants are pulled up and we’re ready to go.’ And he had agreed..everything had calmed down. And one of the officers had asked me for my boarding pass. I stated, ‘I wouldn’t be on the plane, officer, if I didn’t have a boarding pass. I’m just like everybody else on this plane.’ I said I’m just like everybody else on this plane, I’m human. And the pilot said, ‘no you’re not, you’re not like everybody else.’ So you know, I’m just like, okay, I just sat back and let everything take its course-\u003c/p>\n\u003cp>\u003cem>What do you think he meant when he said that? \u003c/em>\u003c/p>\n\u003cp>I don’t’ know. I can’t tell you what the next man is thinking or saying. But he said it, it’s in the past, we’re trying to move forward and handle the situation. But after that, the officer had asked me for my boarding pass. I said, ‘officer, I wouldn’t be on the plane if I didn’t have a boarding pass. I don’t feel a need to show you my boarding pass.’ At that point in time I felt like I was being harassed. They had sent three people to come try to remove me off the plane. I felt like I didn’t do anything wrong, I felt like I paid for my ticket, I paid my fees, I went through the checkpoint and everything all right, security and everything all right. I feel like I didn’t do anything wrong. So why am I being asked to leave my seat, after I complied with the woman – you know I tried but I had my bags in my hand. \u003c/p>\n\u003cp>But after that whole incident they had sent a sheriff from San Mateo County to come talk to me. He was more forthcoming, he talked to me with a benevolent tone. So I could relate to him and talk to him. He asked me to step off the flight. Because they said they didn’t want me on the flight. I could understand after everything that happened. I said, ‘are you guys going to refund my flight so I can make it back to New Mexico?’ He said ‘yes, we’re going to refund your flight.’\u003c/p>\n\u003cp>So I had grabbed my bags off the plane after everybody was evacuated, I had stepped off the plane. As soon as I stepped off the plane an officer approached me and grabbed my wrist. I said ‘excuse me officer I’m not being arrested. You know, we’re walking up to the terminal so I can get on another flight.’ And he was like, ‘no we’re gonna walk you up in handcuffs.’ I ‘m like, ‘I didn’t do anything wrong, why are you arresting me?’ They never mirandized me, they never read me any rights, they never told me why I was being arrested. \u003c/p>\n\u003cp>So after he grabbed my wrist, I told him I didn’t do anything wrong. I had located the sheriff that had talked to me about walking off the plane. I said, ‘sheriff can I follow you up to the terminal?’ He said yes. As soon as I stepped to follow him, they grabbed my arm from behind me, I pulled my arm forward. You know, because anyone who didn’t commit a crime or felt like they didn’t’ do anything would resist arrest. They didn’t’ tell me why I was being arrested, they didn’t read me any rights, they just started grabbing me and putting me in handcuffs. They put me in leg restraints and a chest restraint, and they carried me down where the baggage carts are, and they detained me. \u003c/p>\n\u003cp>\u003cem>You know that they booked you on trespassing, that’s the charge? \u003c/em>\u003c/p>\n\u003cp>I don’t’ see how they book me on trespassing when I’m a paying customer.\u003c/p>\n\u003c/blockquote>\n\u003cp>Marman then spoke about his feelings about sagging pants and his belief that his pants were not unreasonably hanging down. Prosecutors must decide whether Bonds should stand trial on three perjury charges on which a jury deadlocked after a monthlong trial ending April 13. The jury did convict Bonds of felony obstruction of justice after they determined he gave a misleading answer to a question about injecting steroids.\u003c/p>\n\u003cp>Prosecutors argued that the judge should first decide whether to toss out Bonds' conviction for obstruction before scheduling a new trial. "content": "\u003cdiv class=\"post-body\">\u003cp>\u003cp>SAN FRANCISCO (AP) -- A federal judge gave prosecutors more time to decide whether home run record-holder Barry Bonds should face another perjury trial.\u003c/p>\n\u003cp>\u003ca href=\"http://ww2.kqed.org/news/wp-content/uploads/sites/10/2011/06/BarryBonds.jpg\">\u003cimg src=\"http://ww2.kqed.org/news/wp-content/uploads/sites/10/2011/06/BarryBonds.jpg\" alt=\"\" title=\"BarryBonds\" width=\"124\" height=\"154\" class=\"alignleft size-full wp-image-31994\">\u003c/a>U.S. District Judge Susan Illston granted the prosecutors' request Thursday. Prosecutors must decide whether Bonds should stand trial on three perjury charges on which a jury deadlocked after a monthlong trial ending April 13. The jury did convict Bonds of felony obstruction of justice after they determined he gave a misleading answer to a question about injecting steroids.\u003c/p>\n\u003cp>Prosecutors argued that the judge should first decide whether to toss out Bonds' conviction for obstruction before scheduling a new trial. Bonds' attorney have asked for an acquittal or a new trial on the obstruction charge.\u003c/p>\n\u003cp>The two sides are next scheduled back in court on Aug. 26. \u003c/p>\n\u003cp>\u003c/p>\u003c/div>",

Photo Jill Tartow\u003c/figcaption>\u003c/figure>\n\u003cp>Well, this is an interesting development. \u003c/p>\n\u003cp>We first got a glimpse of this photo of a scantily clad US Airways passenger on the fashion blog \u003ca href=\"http://hitdanback.com/us-airways-supported-this-dude-boarding-a-plane/\">Hit Dan Back\u003c/a>. Now a passenger on the June 9 flight on which the man flew has sent the pic to media outlets, which are naturally relating it to the infamous “saggy pants” incident. In that confrontation, college football player Deshon Marman was removed from a US Airways flight for not complying with an employee’s request that he pull up his pants, which were hanging low enough to expose his underwear. Marman was arrested but still hasn’t been charged, \u003ca href=\"http://ww2.kqed.org/news/2011/06/17/interviews-with-deputy-da-and-us-airways-on-saggin-pants-case/\">pending an investigation\u003c/a> by the San Mateo District Attorney’s office. \u003c/p>\n\u003cp>From the \u003ca href=\"http://www.sfgate.com/cgi-bin/article.cgi?f=/c/a/2011/06/22/BAJF1K0V8F.DTL&type=newsbayarea\">Chronicle\u003c/a> today: \u003c/p>\n\u003cblockquote>\u003cp>US Airways spokeswoman Valerie Wunder confirmed she’d received the photo before last week’s incident in San Francisco and had spoken to (Jill) Tarlow (the passenger who sent the photo), but said employees had been correct not to ask the man to cover himself. “We don’t have a dress code policy,” Wunder said. “Obviously, if their private parts are exposed, that’s not appropriate. … So if they’re not exposing their private parts, they’re allowed to fly.”\u003c/p>\n\u003c/blockquote>\n\u003cp>KCBS talked to Jill Tarlow, the passenger who took the photo and complained to US Airways only to be told the man wasn’t breaking airline policy, and to Marman’s attorney, Joe O’Sullivan, who said, “I think maybe the airline has a marketing strategy toward drag queens and against young African Americans.” \u003ca href=\"http://sanfrancisco.cbslocal.com/category/watch-listen/video-on-demand/?autoStart=true&topVideoCatNo=default&clipId=5979924\">\u003cstrong>Video here\u003c/strong>\u003c/a>.\u003c/p>\n\u003cp>Last week, KQED’s Cy Musiker interviewed UC Berkeley law professor Ian Haney Lopez about the incident. Haney Lopez asserted the conflict on the plane over Marman’s pants had a highly racialized aspect to it. “This is really about the new way in which race plays out in the United states,” he said. “Race has always been a combination of biology and culture. The idea that Blacks are too loud, that Latinos are lazy, that Jews are greedy; it’s always been biology and culture. Photo Jill Tartow\u003c/figcaption>\u003c/figure>\n\u003cp>Well, this is an interesting development. \u003c/p>\n\u003cp>We first got a glimpse of this photo of a scantily clad US Airways passenger on the fashion blog \u003ca href=\"http://hitdanback.com/us-airways-supported-this-dude-boarding-a-plane/\">Hit Dan Back\u003c/a>. Now a passenger on the June 9 flight on which the man flew has sent the pic to media outlets, which are naturally relating it to the infamous “saggy pants” incident. In that confrontation, college football player Deshon Marman was removed from a US Airways flight for not complying with an employee’s request that he pull up his pants, which were hanging low enough to expose his underwear. Marman was arrested but still hasn’t been charged, \u003ca href=\"http://ww2.kqed.org/news/2011/06/17/interviews-with-deputy-da-and-us-airways-on-saggin-pants-case/\">pending an investigation\u003c/a> by the San Mateo District Attorney’s office. \u003c/p>\n\u003cp>From the \u003ca href=\"http://www.sfgate.com/cgi-bin/article.cgi?f=/c/a/2011/06/22/BAJF1K0V8F.DTL&type=newsbayarea\">Chronicle\u003c/a> today: \u003c/p>\n\u003cblockquote>\u003cp>US Airways spokeswoman Valerie Wunder confirmed she’d received the photo before last week’s incident in San Francisco and had spoken to (Jill) Tarlow (the passenger who sent the photo), but said employees had been correct not to ask the man to cover himself. “We don’t have a dress code policy,” Wunder said. “Obviously, if their private parts are exposed, that’s not appropriate. … So if they’re not exposing their private parts, they’re allowed to fly.”\u003c/p>\n\u003c/blockquote>\n\u003cp>KCBS talked to Jill Tarlow, the passenger who took the photo and complained to US Airways only to be told the man wasn’t breaking airline policy, and to Marman’s attorney, Joe O’Sullivan, who said, “I think maybe the airline has a marketing strategy toward drag queens and against young African Americans.” \u003ca href=\"http://sanfrancisco.cbslocal.com/category/watch-listen/video-on-demand/?autoStart=true&topVideoCatNo=default&clipId=5979924\">\u003cstrong>Video here\u003c/strong>\u003c/a>.\u003c/p>\n\u003cp>Last week, KQED’s Cy Musiker interviewed UC Berkeley law professor Ian Haney Lopez about the incident. Haney Lopez asserted the conflict on the plane over Marman’s pants had a highly racialized aspect to it. “This is really about the new way in which race plays out in the United states,” he said. “Race has always been a combination of biology and culture. The idea that Blacks are too loud, that Latinos are lazy, that Jews are greedy; it’s always been biology and culture. Now what we have is what we might call a color-blind racism, where one targets the culture but is very careful to never mention anything having to do with biology, and claims on that basis not to be engaged in racial politics at all.”\u003c/p>\n\u003cp>\u003c/p>\u003c/div>",
