Thousands of same-sex couples then \u003ca href=\"http://www.pbs.org/newshour/bb/law/jan-june08/justmarried_06-17.html\">wed\u003c/a>. But the passage of Proposition 8 in November amended the state constitution by limiting marriage to a union of heterosexuals, putting a halt to the marriages.\u003c/p>\n\u003cp>The state Supreme Court was then asked to rule on the issue again, and this time held that the same-sex marriage ban, voter-approved, could stand. The court also ruled, however, that the marriages performed in the brief period that they were allowed would not be abrogated, creating a sort of grandfathering-in of the 18,000 same-sex marriages that had already taken place.\u003c/p>\n\u003cp>The issue having been decided against them on a state level, same-sex marriage advocates then took the case federal, arguing that the ban violated the U.S. Constitution. Attorneys \u003ca href=\"http://en.wikipedia.org/wiki/Theodore_Olson\">Theodore Olson\u003c/a> and \u003ca href=\"http://en.wikipedia.org/wiki/David_Boies\">David Boies\u003c/a>, the legal odd couple that opposed each other in \u003ca href=\"http://www.oyez.org/cases/2000-2009/2000/2000_00_949/\">Bush v. Gore\u003c/a>, argued the case on behalf of two same-sex couples. Judge Vaughn R. Walker ruled in their favor, declaring the ban unconstitutional. But the passage of Proposition 8 in November amended the state constitution by limiting marriage to a union of heterosexuals, putting a halt to the marriages.\u003c/p>\n\u003cp>The state Supreme Court was then asked to rule on the issue again, and this time held that the same-sex marriage ban, voter-approved, could stand. The court also ruled, however, that the marriages performed in the brief period that they were allowed would not be abrogated, creating a sort of grandfathering-in of the 18,000 same-sex marriages that had already taken place.\u003c/p>\n\u003cp>The issue having been decided against them on a state level, same-sex marriage advocates then took the case federal, arguing that the ban violated the U.S. Constitution.
