Which is probably not the biggest news, because he’s already in boiling hot water with Prop 8 proponents for ruling that the initiative is unconstitutional…\u003c/p>\n\u003cp>Nevertheless, as Scott Shafer blogged:\u003c/p>\n\u003cblockquote>\u003cp>Prop 8 supporters say Walker illegally used that clip, which was under seal during the trial and explicitly forbidden from broadcast by the U.S. Supreme Court. In a lawsuit filed with the 9th Circuit Court of Appeal, Prop. 8 attorneys accuse Walker of illegally and unethically using the tapes and ask the court (the same court now considering the appeal of Walker’s decision) to force Walker to turn over all copies of the trial so they won’t be broadcast again.\u003c/p>\u003c/blockquote>\n\u003cp>Below is the clip in question. Walker showed it during a legal seminar on the issue of cameras in the courtroom, at the University of Arizona, Feb. 18. The event was recorded and \u003ca href=\"http://www.c-spanvideo.org/program/298109-3\">archived\u003c/a> online by C-SPAN. You won’t be able to see the proceedings up close, as the camera stays focused on Walker in front of a video screen, but you will be able to hear what’s going on, described this way by Scott Shafer:\u003c/p>\n\u003cp>\u003c!--more-->\u003c/p>\n\u003cblockquote>\u003cp>The clip shows attorney plaintiffs’ David Boies cross-examining Claremont-McKenna political science professor Kenneth Miller on whether Prop. 8 meets his definition of “official” or state sanctioned discrimination. Which is probably not the biggest news, because he’s already in boiling hot water with Prop 8 proponents for ruling that the initiative is unconstitutional…\u003c/p>\n\u003cp>Nevertheless, as Scott Shafer blogged:\u003c/p>\n\u003cblockquote>\u003cp>Prop 8 supporters say Walker illegally used that clip, which was under seal during the trial and explicitly forbidden from broadcast by the U.S. Supreme Court. In a lawsuit filed with the 9th Circuit Court of Appeal, Prop. 8 attorneys accuse Walker of illegally and unethically using the tapes and ask the court (the same court now considering the appeal of Walker’s decision) to force Walker to turn over all copies of the trial so they won’t be broadcast again.\u003c/p>\u003c/blockquote>\n\u003cp>Below is the clip in question. Walker showed it during a legal seminar on the issue of cameras in the courtroom, at the University of Arizona, Feb. 18. Bush in 1989, has never taken pains to disguise - or advertise - his orientation.\u003c/p>\u003c/blockquote>\n\u003cp>Walker himself never spoke about his sexual orientation until yesterday, when the now-retired judge confirmed that fact during a meeting with some reporters. I could find only two original reports from the confab, one from the \u003ca href=\"http://www.sfgate.com/cgi-bin/article.cgi?f=/c/a/2011/04/07/MN661IRCO5.DTL\">Chron\u003c/a> and one from \u003ca href=\"http://www.reuters.com/article/2011/04/06/gaymarriage-judge-idUSN0625669220110406\">Reuters\u003c/a>.\u003cbr>\n\u003c!--more-->\u003c/p>\n\u003cp>From Reuters:\u003c/p>\n\u003cblockquote>\u003cp>The U.S. judge who struck down California's gay marriage ban never considered his own homosexuality as a reason to recuse himself from the case, he said on Wednesday.\u003c/p>\n\u003cp>Former U.S. District Judge Vaughn Walker, who retired from the bench at the end of February, said it would not be appropriate for any judge's sexual orientation, ethnicity, national origin or gender to stop them from presiding over a case.\u003c/p>\n\u003cp>\"That's a very slippery slope,\" Walker said...\u003c/p>\n\u003cp>It was (the) first time Walker publicly acknowledged his own sexual orientation. Walker said he has been in a relationship with the man for 10 years. \"He is a physician,\" Walker said.\u003c/p>\u003c/blockquote>\n\u003cp>And from the Chronicle:\u003c/p>\n\u003cblockquote>\u003cp>The Chronicle first disclosed Walker's sexual orientation during the trial, a fact he had neither discussed publicly nor tried to conceal. Bush in 1989, has never taken pains to disguise - or advertise - his orientation.\u003c/p>\u003c/blockquote>\n\u003cp>Walker himself never spoke about his sexual orientation until yesterday, when the now-retired judge confirmed that fact during a meeting with some reporters. I could find only two original reports from the confab, one from the \u003ca href=\"http://www.sfgate.com/cgi-bin/article.cgi?f=/c/a/2011/04/07/MN661IRCO5.DTL\">Chron\u003c/a> and one from \u003ca href=\"http://www.reuters.com/article/2011/04/06/gaymarriage-judge-idUSN0625669220110406\">Reuters\u003c/a>.\u003cbr>\n\u003c!--more-->\u003c/p>\n\u003cp>From Reuters:\u003c/p>\n\u003cblockquote>\u003cp>The U.S. judge who struck down California's gay marriage ban never considered his own homosexuality as a reason to recuse himself from the case, he said on Wednesday.\u003c/p>\n\u003cp>Former U.S. District Judge Vaughn Walker, who retired from the bench at the end of February, said it would not be appropriate for any judge's sexual orientation, ethnicity, national origin or gender to stop them from presiding over a case.\u003c/p>\n\u003cp>\"That's a very slippery slope,\" Walker said...\u003c/p>\n\u003cp>It was (the) first time Walker publicly acknowledged his own sexual orientation. Walker said he has been in a relationship with the man for 10 years. \"He is a physician,\" Walker said.\u003c/p>\u003c/blockquote>\n\u003cp>And from the Chronicle:\u003c/p>\n\u003cblockquote>\u003cp>The Chronicle first disclosed Walker's sexual orientation during the trial, a fact he had neither discussed publicly nor tried to conceal. She also defended the state court's scheduling of the case, the expedited timeline of which she called \"unprecedented,\" despite the request of anti-Prop 8 lawyers for an even faster resolution. And she addressed a frequent point of contention: whether judges let their personal beliefs interfere with their decisions:\u003cbr>\n\u003c!--more-->\u003cbr>\n\"I believe that in my 20 years I have not ever seen a judge be influenced by his or her personal beliefs on the matter,\" she said. \"I think perhaps there might be an evolution of a judge, so that one who is a new and inexperienced judge is going to face those questions for the first time, and that in facing those questions for first time is going to have to harken back to his or her oath, and remember that you are making these decisions on these issues regardless of how political they are based on the constitution and the rule of law. It prevents same sex couples who get married in states where it’s legal from getting federal rights bestowed on other married couples, like tax breaks and Social Security benefits when a spouse dies.\u003c/p>\n\u003cp> \u003c/p>\n\u003cp>So when Attorney General Eric Holder \u003ca href=\"http://www.justice.gov/opa/pr/2011/February/11-ag-222.html\">announced\u003c/a> that the Obama Administration would no longer defend DOMA, civil rights advocates cheered. Some in the LGBT community, notably Geoff Kors of \u003ca href=\"http://www.eqca.org/site/pp.asp?c=kuLRJ9MRKrH&b=5609559\">Equality California\u003c/a>, have been seering in their criticism of what they saw as Obama’s hypocrisy after promising to be a “fierce advocate” for gay rights in his 2008 campaign.\u003c/p>\n\u003cp>Less than two hours after that announcement, attorneys opposing Prop. 8 were on a \u003ca href=\"http://ww2.kqed.org/news/2011/02/23/david-boies-theodore-olson-proposition-8-news-conference/\">conference call\u003c/a> with reporters. Conservative Republican-turned gay rights champion Ted Olson hailed the administration’s decision — and deftly blended it into \u003ca href=\"http://www.afer.org/news/afer-asks-u-s-court-of-appeals-to-lift-the-stay-on-marriage-for-gay-and-lesbian-couples/\">court filings\u003c/a> with the 9th Circuit Court of Appeals his side had made.\u003c/p>\n\u003cp>Olson’s team wants the 9th Circuit to lift its stay of federal Judge Vaughn Walker’s decision striking down Prop. 8 as unconstitutional. That motion was already in play when Wednesday’s blockbuster announcement came from the AG. Some in the LGBT community, notably Geoff Kors of \u003ca href=\"http://www.eqca.org/site/pp.asp?c=kuLRJ9MRKrH&b=5609559\">Equality California\u003c/a>, have been seering in their criticism of what they saw as Obama’s hypocrisy after promising to be a “fierce advocate” for gay rights in his 2008 campaign.\u003c/p>\n\u003cp>Less than two hours after that announcement, attorneys opposing Prop. 8 were on a \u003ca href=\"http://ww2.kqed.org/news/2011/02/23/david-boies-theodore-olson-proposition-8-news-conference/\">conference call\u003c/a> with reporters.
