The 1993 \"don't ask, don't tell\" rule says gays may serve but only if they keep secret their sexual orientation.\u003c/p>\n\u003cp>Government lawyers sought to suspend U.S. District Judge Virginia Phillips's ruling while appeals were pending, arguing that it would pose a major problem for the military. In an order released this afternoon, she said the Justice Department had not proved the military would suffer \"irreparable harm\" by allowing her order to take effect. She says that:\u003c/p>\n\u003cblockquote>\u003cp>“Although Defendants objected to the issuance of the injunction and its scope, they provided no evidence regarding the alleged disruption or need to revise ‘dozens of policies and regulations,’ as described in [a government declaration.]”\u003c/p>\u003c/blockquote>\n\u003cp>The administration is expected to ask the Ninth U.S. Circuit Court of Appeals in San Francisco for a stay while Phillips’s “Don’t Ask, Don’t Tell” order is under appeal. The gathering was attended by 200 people at the Marin County Office of Education. The Marin Education office has put up a \u003cstrong>\u003ca href=\"http://mcoeweb.marin.k12.ca.us/schoollawb2/SuicidePrevention/SuicidePreventionGateway.htm\">\u003cstrong>web site\u003c/strong>\u003c/a> \u003c/strong>with resources related to teen mental health and suicide prevention. The site includes \u003ca href=\"http://mcoeweb.marin.k12.ca.us/schoollawb2/SuicidePrevention/SuicidePreventionFAQs.pdf\">frequently asked questions\u003c/a>, \u003ca href=\"http://mcoeweb.marin.k12.ca.us/schoollawb2/SuicidePrevention/ActionSteps-English.html\">action steps for students\u003c/a>, and the \u003ca href=\"http://mcoeweb.marin.k12.ca.us/schoollawb2/SuicidePrevention/SuicideHotline-English.pdf\">24-hour suicide prevention\u003c/a> phone number.\u003c/p>\n\u003cp>Another Marin-related suicide occurred on October 5 when area-born Aiyisha Hassan, a 20-year old college student who was \u003ca title=\"Metro Weekly: Mourning at Howard\" href=\"http://www.metroweekly.com/news/?ak=5654\">struggling\u003c/a> with her sexual identity, \u003ca title=\"The Snitch: LGBT suicide\" href=\"http://blogs.sfweekly.com/thesnitch/2010/10/lgbt_suicides_aiyisha_hassan_d.php\">killed herself\u003c/a>. Despite a recent \u003ca href=\"http://blog.seattlepi.com/seattlepolitics/archives/222744.asp\">poll\u003c/a> finding that 59% of Americans support repeal of Don't Ask Don't Tell, which has resulted in thousands of \u003ca title=\"Chart: Number of discharges/year\" href=\"http://en.wikipedia.org/wiki/Don%27t_ask,_don%27t_tell#Number_of_discharges\">gay and lesbian military discharges\u003c/a>, the Obama administration has yet to announce if it will appeal the ruling and ask a higher court to re-instate the policy.\u003c/p>\n\u003cp>The L.A. Times' \u003ca href=\"http://latimesblogs.latimes.com/washington/2010/10/dont-ask-dont-tell-log-cabin-republicans-.html\">\u003c/a> Top of the Ticket blog summarizes the administration's \u003ca href=\"http://latimesblogs.latimes.com/washington/2010/10/dont-ask-dont-tell-log-cabin-republicans-.html\">political dilemma\u003c/a> and posits a likely short-term solution:\u003c/p>\n\u003cblockquote>\u003cp>Don't ask, don't tell was totally banned by a federal judge near Los Angeles Tuesday, creating a major political predicament for Democratic President Barack Obama just 20 days before crucial midterm elections that already augured ill for his party...\u003c/p>\n\u003cp>Fortunately for administration political reasons, Obama has 60 days to file an appeal, a timespan that will get him past the Nov. 2 midterm elections when numerous current polls indicate his party will likely endure a shellacking in congressional elections, and possibly at state levels as well.\u003c/p>\n\u003cp>Appealing the court's ruling now would anger a major element of the Democrat base, possibly adversely affecting some elections and widespread turnout. A decision not to appeal would be the easiest for the administration, which could simply abide by the court's ruling.\u003c/p>\n\u003cp>That could, however, cause further damage among conservatives and many in the military who favor Don't Ask, Don't Tell as is. And not proceeding would shortcircuit the ongoing review within the military community. Sure, that might involve some political risk in conservative districts, but it would also demonstrate to voters on the left that this administration is actually willing to take a stand on an issue that is important to progressives and other believers in social justice...\u003c/p>\n\u003cp>Obama opposes same-sex marriage, and when the Democrat's made a showy legislative move last month to end DADT, they quickly caved in the face of a Republican filibuster, making the whole gesture seem like a meaningless election year gimmick rather than an honest effort to end a policy that has always been unconstitutional, as this judge has now ruled.\u003c/p>\n\u003cp>So now, it's gut check time. Obama needs to show what kind of president he wants to be.
