"content": "\u003cp>\u003cem>Update Feb 16\u003c/em>: The City Council \u003ca href=\"http://www.nytimes.com/aponline/2011/02/15/us/AP-US-Guantanamo-Detainees-Berkeley.html?_r=1&ref=aponline\">rejected\u003c/a> the Guantanamo measure 4-1, with four abstentions. \u003c/p>\n\u003cp>It also \u003ca href=\"http://www.contracostatimes.com/bay-area-news/ci_17401758?nclick_check=1\">approved\u003c/a> a resolution calling for the \"immediate end to the cruel, inhuman, and degrading treatment\" of Wikileaks whisteblower Bradley Manning, the Army private being held in a military prison on charges of leaking classified documents.\u003c/p>\n\u003cp>\u003cem>Yesterday's post\u003c/em>\u003cbr>\nTonight's the night, Berkeley watchers. The City Council will \u003ca href=\"http://www.ktvu.com/politics/26872049/detail.html\">\u003cstrong>consider a resolution\u003c/strong>\u003c/a> inviting former Guantanamo detainees who have been cleared of illegality to take up residence there.\u003c/p>\n\u003cp>You can \u003ca href=\"http://www.ci.berkeley.ca.us/uploadedFiles/Clerk/Level_3_-_City_Council/2011/02Feb/2011-02-15_Item_18a_The_Safe_Resettlement_of_Cleared_Guantinamo_Detainees-PJC.pdf\">peruse the resolution\u003c/a> here. It reads:\u003c/p>\n\u003cblockquote>\u003cp>The Peace and Justice Commission, consistent with its mandate to promote peace and justice, locally, nationally and internationally, recommends that the United States lift its ban on the domestic repatriation of cleared Guantanamo detainees and that following the removal of this legal impediment, that assistance be given for their safe resettlement to the United States. It is proposed that the City of Berkeley then welcome one or two detainees to live in Berkeley, with needed housing and other support offered by the Berkeley community. \u003c/p>\n\u003cp>The City has a longstanding policy in support of peace and justice including previously welcoming refugees from other countries who unjustly suffered imprisonment, torture, and related traumatic experiences. Consistent with that policy leadership, the Council\u003cbr>\nof the City of Berkeley is urged to take a position to support the resettlement of one or two Guantanamo detainees to Berkeley. Here's a snippet from an American Thinker blog post called \"\u003ca href=\"http://www.americanthinker.com/blog/2011/02/plant_a_tree_and_hug_a_terrori.html\">Plant a Tree and Hug a Terrorist\u003c/a>:\"\u003c/p>\n\u003cblockquote>\u003cp>\n...in response to the recommendation of the Peace and Justice Commission, the Berkeley City Council plans to vote on a motion to share a cup of sugar with a terrorist. According to Peace and Justice Commissioner Rita Maran, the proposal is a way to welcome to the community \"the kind of people you'd like to have living next door to you or dating your cousin.\"\u003c/p>\n\u003cp>Receiving \"new neighbors\" from Guantanamo Bay could make the home to heiress/bank robber Patty Hearst, the late LSD guru Dr. Timothy Leary, and deceased Communist-poet Allen Ginsberg even more notorious than before.\u003c/p>\u003c/blockquote>\n\u003cp>Chronicle columnist \u003ca href=\"http://www.sfgate.com/cgi-bin/article.cgi?file=/c/a/2011/02/12/BAR61HLNEJ.DTL\">Debra Saunders\u003c/a> has a marginally less loathing take on the matter:\u003c/p>\n\u003cblockquote>\u003cp>The Berkeley City Council remains in the easy seat where talk is cheap. Or as UC Berkeley law professor and former Bush White House attorney John Yoo noted, \"It's the perfect combination of futility and stupidity. It is futile, because what happens to Gitmo detainees is up to the federal government. It is stupid because only Berkeley would want to be a magnet for resettlement of Gitmo detainees.\"\u003c/p>\n\u003cp>Pity the poor Peace and Justice crowd. Gone is the cheap thrill of pretending that all of America's problems would go away if only George W. Bush weren't in the White House. So in a new act of fiction, Berzerkeley plays make-believe by pretending that two Gitmo detainees should be dating your cousin.\n\u003c/p>\u003c/blockquote>\n\u003cp>(For a refutation of the case Saunders makes against two detainees cited by Berkeley as possible settlement candidates, check out this \u003ca href=\"http://my.firedoglake.com/valtin/2011/02/14/sf-chronicle-columnist-slimes-waterboarding-victim-in-bid-to-stop-berkeley-resolution-on-guantanamo-detainees/\">Firedoglake post\u003c/a>.)\u003c/p>\n\u003cp>Just recently the city also took another p.r. pounding, on the now-delayed \u003ca href=\"http://articles.sfgate.com/2010-12-16/bay-area/25193934_1_collateral-murder-army-helicopter-attack-wikileaks\">vote\u003c/a> to honor Wikileaks' whistleblower Bradley Manning. And it's true -- what some may consider to be misguided dogooderism does make a tempting target.\u003c/p>\n\u003cp>\u003c/p>\n\u003cp>But don't you think there's something appealing about a place that always \u003cem>tries\u003c/em> to do the right thing, even if it doesn't always get it right?\u003c/p>\n\n",

The City Council will \u003ca href=\"http://www.ktvu.com/politics/26872049/detail.html\">\u003cstrong>consider a resolution\u003c/strong>\u003c/a> inviting former Guantanamo detainees who have been cleared of illegality to take up residence there.\u003c/p>\n\u003cp>You can \u003ca href=\"http://www.ci.berkeley.ca.us/uploadedFiles/Clerk/Level_3_-_City_Council/2011/02Feb/2011-02-15_Item_18a_The_Safe_Resettlement_of_Cleared_Guantinamo_Detainees-PJC.pdf\">peruse the resolution\u003c/a> here. It reads:\u003c/p>\n\u003cblockquote>\u003cp>The Peace and Justice Commission, consistent with its mandate to promote peace and justice, locally, nationally and internationally, recommends that the United States lift its ban on the domestic repatriation of cleared Guantanamo detainees and that following the removal of this legal impediment, that assistance be given for their safe resettlement to the United States. It is proposed that the City of Berkeley then welcome one or two detainees to live in Berkeley, with needed housing and other support offered by the Berkeley community. \u003c/p>\n\u003cp>The City has a longstanding policy in support of peace and justice including previously welcoming refugees from other countries who unjustly suffered imprisonment, torture, and related traumatic experiences. Consistent with that policy leadership, the Council\u003cbr>\nof the City of Berkeley is urged to take a position to support the resettlement of one or two Guantanamo detainees to Berkeley. Similar actions were adopted by the cities of Amherst and Leverette, both in Massachusetts.\u003c/p>\u003c/blockquote>\n\u003cp>City Manager Phil Kamlarz, however, is not in harmony with the cause, citing federal law prohibiting the settlement of former detainees in the U.S. \u003c/p>\n\u003cp>\u003c/p>\u003c/div>",

According to Peace and Justice Commissioner Rita Maran, the proposal is a way to welcome to the community \"the kind of people you'd like to have living next door to you or dating your cousin.\"\u003c/p>\n\u003cp>Receiving \"new neighbors\" from Guantanamo Bay could make the home to heiress/bank robber Patty Hearst, the late LSD guru Dr. Timothy Leary, and deceased Communist-poet Allen Ginsberg even more notorious than before.\u003c/p>\u003c/blockquote>\n\u003cp>Chronicle columnist \u003ca href=\"http://www.sfgate.com/cgi-bin/article.cgi?file=/c/a/2011/02/12/BAR61HLNEJ.DTL\">Debra Saunders\u003c/a> has a marginally less loathing take on the matter:\u003c/p>\n\u003cblockquote>\u003cp>The Berkeley City Council remains in the easy seat where talk is cheap. Or as UC Berkeley law professor and former Bush White House attorney John Yoo noted, \"It's the perfect combination of futility and stupidity. It is futile, because what happens to Gitmo detainees is up to the federal government. It is stupid because only Berkeley would want to be a magnet for resettlement of Gitmo detainees.\"\u003c/p>\n\u003cp>Pity the poor Peace and Justice crowd. Gone is the cheap thrill of pretending that all of America's problems would go away if only George W. Bush weren't in the White House. (No wonder Anthony Batts wanted in.) No. 2 on the list is Fire Chief Darryl Von Raesfeld, also retired, at $430,108. People moan and complain about these salaries but if you ask them to do the work, they wouldn’t want any part of it.\u003cbr>\n-------------------------------------------------------------------------------------------------------------------------------\u003cbr>\nGive me a break, when you have 4,000 people apply for 20 firefighter jobs don’t tell me that no one wants to do that job. We should be paying them half the salaries they are currently getting. When you take into account their work schedule and the fact that they are actually paid for sleeping on the job they are grossly overpaid.\u003cbr>\n-------------------------------------------------------------------------------------------------------------------------------\u003c/p>\n\u003cp>The city of San Jose should have salary caps at all branches. 185,000... We can find people in this valley willing to perform at an acceptable level for this figure. City Council should be a part time position with “NO” benefits. After all the city hires professionals to determine decisions with spending. Police and fire should have No overtime above the rank of hiring. First line Supervisors working in the field would be exempt... Seems like the people gaining the most from overtime are the supervisors of these organizations...\u003cbr>\n-------------------------------------------------------------------------------------------------------------------------------\u003cbr>\nWow! I guesss this explains why Oakland Chief of Police Anthony Batts was tempted to leave Oakland and take the San Jose job. "content": "\u003cp>Craig Miller of KQED has a provocative post up on Climate Watch titled \u003ca href=\"http://blogs.kqed.org/climatewatch/2011/02/02/is-ab-32-headed-for-the-rocks/\">\u003cstrong>\u003ca href=\"http://blogs.kqed.org/climatewatch/2011/02/02/is-ab-32-headed-for-the-rocks/\">Is AB 32 Headed for the Rocks?\u003c/a>\u003c/strong>\u003c/a>\u003c/p>\n\u003cp>The post points to Legal Planet, an environmental law and policy blog, where Cara Horowitz, Executive Director of the UCLA Emmett Center on Climate Change and the Environment, \u003ca href=\"http://legalplanet.wordpress.com/2011/02/02/calif-court-tentatively-rules-ab-32-implementation-unlawful/\">\u003cstrong>wrote this\u003c/strong>\u003c/a>: \u003c/p>\n\u003cblockquote>\u003cp>A California superior court has issued a \u003ca href=\"http://cdn.law.ucla.edu/SiteCollectionDocuments/Environmental%20Law/AIR%20v%20ARB%20Tentative%20Ruling.pdf\">proposed decision\u003c/a>, not yet final, holding that (the \u003ca href=\"http://www.arb.ca.gov/homepage.htm\">Air Resources Board\u003c/a>) failed to comply with the \u003ca href=\"http://ceres.ca.gov/ceqa/more/faq.html\">California Environmental Quality Act\u003c/a> (CEQA) in its adoption of the Scoping Plan that is guiding its implementation of AB 32, California’s landmark climate change law. \u003c/p>\n\u003cp>The ruling proposes to set aside ARB’s CEQA documentation and to enjoin “any implementation of the Scoping Plan” until ARB corrects the CEQA violation. Among other things, such a ruling would presumably affect the roll-out of California’s first-in-the-nation carbon cap and trade program, which is slated to take effect in January 2012.\u003c/p>\n\u003cp>Though the tentative ruling was signed on Jan. 21 and served on parties last week, not much has been written about it. Under California Rule of Court 3.1590(g), the parties appear to have 15 days from service to lodge objections to the proposed ruling. The ruling comes in a case brought by community groups, environmental justice organizations, and individuals opposed to ARB’s scoping plan and, in particular, to the cap and trade program. Among the plaintiffs are members of the Environmental Justice Advisory Committee, which advised ARB on the creation of the Scoping Plan and made its objections to the plan plain from the start. \u003ca href=\"http://legalplanet.wordpress.com/2011/02/02/calif-court-tentatively-rules-ab-32-implementation-unlawful/\">Full post\u003c/a>\n\u003c/p>\u003c/blockquote>\n\u003cp>\u003c!--more-->\u003cbr>\nNote this follow-up \u003ca href=\"http://legalplanet.wordpress.com/2011/02/02/courts-ab-32-ruling-is-quite-narrow-and-at-most-a-temporary-setback/\">\u003cstrong>post\u003c/strong>\u003c/a> by Ann Carlson, another UCLA environmental law professor, which minimizes the impact of the ruling: \u003c/p>\n\u003cblockquote>\u003cp>The CEQA portion of the ruling — should the judge stick with it when he finalizes his decision — is a setback for efforts to implement California’s law. But I think it’s worth emphasizing that it’s only a temporary setback and one that may not even have the effect of delaying the air board’s climate change plan. Here’s why:\u003c/p>\n\u003cp>First, if the judge’s decision is finalized, CARB will very likely appeal and will very likely seek (and may well win) a stay of the injunction preventing the Scoping Plan (which sets forth how CARB will implement AB 32) from going into effect;\u003c/p>\n\u003cp>Second, if CARB succeeds in getting the injunction stayed, it can work during the lengthy appellate process to fix the violations of CEQA so that even if CARB loses on appeal it loses no implementation time. "content": "\u003cdiv class=\"post-body\">\u003cp>\u003cp>Craig Miller of KQED has a provocative post up on Climate Watch titled \u003ca href=\"http://blogs.kqed.org/climatewatch/2011/02/02/is-ab-32-headed-for-the-rocks/\">\u003cstrong>\u003ca href=\"http://blogs.kqed.org/climatewatch/2011/02/02/is-ab-32-headed-for-the-rocks/\">Is AB 32 Headed for the Rocks?\u003c/a>\u003c/strong>\u003c/a>\u003c/p>\n\u003cp>The post points to Legal Planet, an environmental law and policy blog, where Cara Horowitz, Executive Director of the UCLA Emmett Center on Climate Change and the Environment, \u003ca href=\"http://legalplanet.wordpress.com/2011/02/02/calif-court-tentatively-rules-ab-32-implementation-unlawful/\">\u003cstrong>wrote this\u003c/strong>\u003c/a>: \u003c/p>\n\u003cblockquote>\u003cp>A California superior court has issued a \u003ca href=\"http://cdn.law.ucla.edu/SiteCollectionDocuments/Environmental%20Law/AIR%20v%20ARB%20Tentative%20Ruling.pdf\">proposed decision\u003c/a>, not yet final, holding that (the \u003ca href=\"http://www.arb.ca.gov/homepage.htm\">Air Resources Board\u003c/a>) failed to comply with the \u003ca href=\"http://ceres.ca.gov/ceqa/more/faq.html\">California Environmental Quality Act\u003c/a> (CEQA) in its adoption of the Scoping Plan that is guiding its implementation of AB 32, California’s landmark climate change law. \u003c/p>\n\u003cp>The ruling proposes to set aside ARB’s CEQA documentation and to enjoin “any implementation of the Scoping Plan” until ARB corrects the CEQA violation. Among other things, such a ruling would presumably affect the roll-out of California’s first-in-the-nation carbon cap and trade program, which is slated to take effect in January 2012.\u003c/p>\n\u003cp>Though the tentative ruling was signed on Jan. 21 and served on parties last week, not much has been written about it. Under California Rule of Court 3.1590(g), the parties appear to have 15 days from service to lodge objections to the proposed ruling. The ruling comes in a case brought by community groups, environmental justice organizations, and individuals opposed to ARB’s scoping plan and, in particular, to the cap and trade program. Among the plaintiffs are members of the Environmental Justice Advisory Committee, which advised ARB on the creation of the Scoping Plan and made its objections to the plan plain from the start. \u003ca href=\"http://legalplanet.wordpress.com/2011/02/02/calif-court-tentatively-rules-ab-32-implementation-unlawful/\">Full post\u003c/a>\n\u003c/p>\u003c/blockquote>\n\u003cp>\u003c!--more-->\u003cbr>\nNote this follow-up \u003ca href=\"http://legalplanet.wordpress.com/2011/02/02/courts-ab-32-ruling-is-quite-narrow-and-at-most-a-temporary-setback/\">\u003cstrong>post\u003c/strong>\u003c/a> by Ann Carlson, another UCLA environmental law professor, which minimizes the impact of the ruling: \u003c/p>\n\u003cblockquote>\u003cp>The CEQA portion of the ruling — should the judge stick with it when he finalizes his decision — is a setback for efforts to implement California’s law. But I think it’s worth emphasizing that it’s only a temporary setback and one that may not even have the effect of delaying the air board’s climate change plan. Here’s why:\u003c/p>\n\u003cp>First, if the judge’s decision is finalized, CARB will very likely appeal and will very likely seek (and may well win) a stay of the injunction preventing the Scoping Plan (which sets forth how CARB will implement AB 32) from going into effect;\u003c/p>\n\u003cp>Second, if CARB succeeds in getting the injunction stayed, it can work during the lengthy appellate process to fix the violations of CEQA so that even if CARB loses on appeal it loses no implementation time. The violations are largely about conducting a more thorough analysis of alternatives to the Scoping Plan...\u003c/p>\n\u003cp>So the tentative ruling, should it become permanent, will create some bumps in the road toward AB 32 implementation but I predict that the bumps will be only small ones. \u003c/p>\u003c/blockquote>\n\u003cul>\n\u003cli>\u003ca href=\"http://cdn.law.ucla.edu/SiteCollectionDocuments/Environmental%20Law/AIR%20v%20ARB%20Tentative%20Ruling.pdf\">Read the court's proposed decision here\u003c/a>\u003c/li>\n\u003c/ul>\n\u003cp>\u003c/p>\u003c/div>",
