"bio": "• I write and edit stories about how Silicon Valley power and policies shape everyday life in California. I’m also passionate about making Bay Area history and culture more accessible to a broad public. • I’ve been a journalist for most of my life, starting in high school with The Franklin Press in Los Angeles, where I grew up. While earning my first degree in English at UC Berkeley, I got my start in public radio at KALX-FM. After completing a second degree in journalism at Cal, I landed my first professional job at Marketplace, then moved on to KPCC (now LAist), and then KQED, where I hosted The California Report for more than seven years. • My reporting has appeared on NPR, The World, WBUR’s \u003ci>Here & Now\u003c/i>, and the BBC. I also guest host for KQED’s \u003ci>Forum\u003c/i>, as well as the Commonwealth Club in San Francisco. • I speak periodically on media, democracy and technology issues, and do voiceover work for documentaries and educational video projects. • Outside of the studio, you'll find me hiking Bay Area trails and whipping up Insta-ready meals in my kitchen. • I do not accept gifts, money, or favors from anyone connected to my reporting, I don't pay people for information, and I do not support or donate to political causes. • I strive to treat the people I report on with fairness, honesty, and respect. I also recognize there are often multiple sides to a story and work to verify information through multiple sources and documentation. If I get something wrong, I correct it.",

But it took an intervention by a U.S. Senator -- Dick Durbin from Illinois -- to stall the process.\u003c/p>\n\u003cp>According to the Rengifos' lawyer, Rhoda Wilkinson Domingo, Mr. Rengifo’s wife is not subject to an order of removal, and another son is a permanent resident. Wilkinson Domingo also sent out the following background information yesterday: \u003c/p>\n\u003cblockquote>\u003cp>Mr. Rengifo and his family fled from Peru in 1993 after they were attacked and threatened by the Shining Path, a terrorist guerilla movement that now engages in highly dangerous narcotics trafficking. ICE attorneys and agents, however, will be tasked to review each case prior to the expenditure of resources to determine whether it is a priority case as defined in the June 30, 2010 Civil Enforcement Priorities memorandum and the June 17, 2011 Prosecutorial Discretion memorandum. Removals will continue while the working group undertakes its review.\u003c/p>\n\u003cp>\u003cstrong>Can individuals affirmatively apply for an exercise of discretion through this process? \u003c/strong>\u003c/p>\n\u003cp>No. This process does not involve the creation of an affirmative application process, although, consistent with longstanding practice, individuals in removal proceedings and their representatives remain free to submit information relevant to their case to the appropriate ICE field offices or attorneys. "content": "\u003cp>You may be aware of the unenviable position that Bradford Wells and Anthony John Makk, a same-sex couple who live in San Francisco, find themselves in. \u003c/p>\n\u003cp>Wells and Makk have lived together 19 years. Seven years ago, they wed in Massachussetts, where same-sex marriages are legal. Makk is the primary caregiver for Wells, who has AIDS. He is also, however, a citizen of Australia, and U.S. Immigration and Customs Enforcement \u003ca href=\"http://articles.sfgate.com/2011-08-09/bay-area/29866637_1_marriage-act-immigration-equality-immigration-benefits\">will not grant\u003c/a> him permanent residency as the spouse of a U.S. citizen, because the Defense of Marriage Act specifically prohibits such federal benefits to same-sex couples. Earlier this year, the Obama administration said it would stop defending the law in court, but it is still currently the law of the land. \u003c/p>\n\u003cp>In July, ICE ordered Makk to leave the country by August 25. But the couple has appealed the decision, which has bought them some extra time, and last week the Obama administration announced that it is de-emphasizing \"low-priority\" deportation cases that meet certain criteria, some of which Makk and Wells meet. On Monday, a San Francisco judge, at the request of immigration officials, \u003ca href=\"http://ww2.kqed.org/news/2011/08/23/judge-closes-deportation-case-against-same-sex-couple-after-obama-immigration-shift-sf-couple-awaits/\">closed\u003c/a> a deportation case against a Venezuelan who had overstayed his visa but had married an American citizen. \u003c!--more-->\u003c/p>\n\u003cp>On Monday, KQED's Mina Kim talked to Bradford Wells about his situation. An edited transcript follows the audio below. \u003c/p>\n\u003cp>\u003cem>Interview with Bradford Wells Part 1\u003c/em>\u003cbr>\n[audio:http://ww2.kqed.org/news/wp-content/uploads/sites/10/2011/08/wellsfirst.mp3|titles=wellsfirst]\u003c/p>\n\u003cblockquote>\n\u003cp>\u003cstrong>What's your current status?\u003c/strong>\u003c/p>\n\u003cp>My married husband and I filed for a spousal visa and it was denied up front using the Defense of Marriage Act, which says the federal government does not recognize any marriage between two people of the same sex and any such marriage is not eligible for any federal benefits whatsoever. \u003c/p>\n\u003cp>\u003cstrong>What is supposed to happen August 25?\u003c/strong>\u003c/p>\n\u003cp>On that date, either Anthony must leave the country or we have to have an appeal filed. My lawyer is working on the appeal right now. We'll have it filed by the deadline. \u003c/p>\n\u003cp>\u003cstrong>What would it mean to you if Anthony was forced to leave the country? \u003c/strong>\u003c/p>\n\u003cp>I'd be devastated. I don’t know what I would do but I know I would not be able to take care of everything myself. I depend on him for my day to day living. I just can't see going on with him not here. I don't know how I'd manage. I have some pretty significant health issues and he's my primary caregiver. He assists me with taking medications, he assists me with things I can't do. Some mornings I'm in so much pain I can't get out of bed without his help. He gets medication for me when I can't go get them. He helps me with medication I have to inject; I find it very difficult to that myself. \u003c/p>\n\u003cp>Every time a helicopter goes overhead I cringe. I know he's not under an order of deportation right now, but we are two people who have spent the last 19 years working diligently to make sure he was here legally the whole time. We've spent countless hours and significant resources making sure he obeyed the law. He's never once violated his visa. He is also, however, a citizen of Australia, and U.S. Immigration and Customs Enforcement \u003ca href=\"http://articles.sfgate.com/2011-08-09/bay-area/29866637_1_marriage-act-immigration-equality-immigration-benefits\">will not grant\u003c/a> him permanent residency as the spouse of a U.S. citizen, because the Defense of Marriage Act specifically prohibits such federal benefits to same-sex couples. Earlier this year, the Obama administration said it would stop defending the law in court, but it is still currently the law of the land. \u003c/p>\n\u003cp>In July, ICE ordered Makk to leave the country by August 25. But the couple has appealed the decision, which has bought them some extra time, and last week the Obama administration announced that it is de-emphasizing \"low-priority\" deportation cases that meet certain criteria, some of which Makk and Wells meet. Jerry Brown on Monday signed a bill that will let students who entered the country illegally receive private financial aid at California's public colleges, even as debate continues over a more contentious bill that would allow access to public funding.\u003c/p>\n\u003cp>The Democratic governor signed AB130 at Los Angeles City College. It is the first of a two-bill package referred to as the California Dream Act, which is aimed at getting financial aid for college students who entered the country illegally.\u003c/p>\n\u003cp>\"It's crucial that we invest in every child that lives and is born in this state. Signing this Dream Act is another piece of investment in people because people drives the culture, the economy,\" Brown told a crowd of about 100 students and community leaders who gathered inside the city college's library. \"This is another piece of a very important mosaic which is a California that works for everyone.\"\u003c/p>\n\u003cp>The governor did not address the second bill in the package, which is more contentious because it would allow illegal immigrants to receive state-funded scholarships and financial aid. That bill, AB131, is in the state Senate. \u003c/p>\n\u003cp>The legislative package authored by state Assemblyman Gil Cedillo, D-Los Angeles, differs from the federal Dream Act, which would include a path to citizenship for those bought to the country illegally as children. \u003c!--more-->\u003c/p>\n\u003cp>[ad fullwidth]\u003c/p>\n\u003cp>Critics of the package say granting public or private financial aid to illegal immigrants will force citizens and students who are here legally to compete with them for limited resources. Assemblyman Tim Donnelly, R-Twin Peaks, said California's public colleges and universities have already had to raise tuition fees in the face of recent budget cuts.\u003c/p>\n\u003cp>\"Bottom line is California doesn't have enough money to take care of its obligations to its citizens right now,\" Donnelly said. \"The people, who if they're lucky enough to have jobs, certainly would like those limited resources to go to their children or grandchildren. They certainly wouldn't want that to go to people who come here illegally.\"\u003c/p>\n\u003cp>Cedillo said he admired the students without legal status because of the obstacles they have had to overcome. He said allowing students to qualify for private scholarships and financial aid is one step that will help them get through college.\u003c/p>\n\u003cp>\"Public education in this great state and this great country is a great equalizer of society,\" he said.\u003c/p>\n\u003cp>California's community college and public universities systems support the bill, noting that it affects less than 1 percent of their student population. According to the University of California, fewer than 80 students across its system of more than 220,000 students would be affected by the bill signed Monday.\u003c/p>\n\u003cp>The California State University estimated that some of the 3,600 students who have permission to pay in-state tuition rates even though they lack legal documentation could be affected by the new law. The CSU system enrolls about 440,000 students.\u003c/p>\n\u003cp>At least one student who stands to benefit from the California Dream Act said an education will improve his perspective and quality of life even if he'll still have trouble finding work out of college. Rigoberto Barboza, a 21-year-old from Mexico who studies sociology at Mt. San Antonio College in Walnut, Calif., said the new law could help him take more courses and finish sooner.\u003c/p>\n\u003cp>\u003c/p>\n\u003cp>\"Education is the only way to free from oppression - this oppression we illegals live with,\" he said. \"Education allows me to see which laws affect us and how.\"\u003c/p>\n\n",

Assemblyman Tim Donnelly, R-Twin Peaks, said California's public colleges and universities have already had to raise tuition fees in the face of recent budget cuts.\u003c/p>\n\u003cp>\"Bottom line is California doesn't have enough money to take care of its obligations to its citizens right now,\" Donnelly said. \"The people, who if they're lucky enough to have jobs, certainly would like those limited resources to go to their children or grandchildren. They certainly wouldn't want that to go to people who come here illegally.\"\u003c/p>\n\u003cp>Cedillo said he admired the students without legal status because of the obstacles they have had to overcome. He said allowing students to qualify for private scholarships and financial aid is one step that will help them get through college.\u003c/p>\n\u003cp>\"Public education in this great state and this great country is a great equalizer of society,\" he said.\u003c/p>\n\u003cp>California's community college and public universities systems support the bill, noting that it affects less than 1 percent of their student population. According to the University of California, fewer than 80 students across its system of more than 220,000 students would be affected by the bill signed Monday.\u003c/p>\n\u003cp>The California State University estimated that some of the 3,600 students who have permission to pay in-state tuition rates even though they lack legal documentation could be affected by the new law. The CSU system enrolls about 440,000 students.\u003c/p>\n\u003cp>At least one student who stands to benefit from the California Dream Act said an education will improve his perspective and quality of life even if he'll still have trouble finding work out of college. Rigoberto Barboza, a 21-year-old from Mexico who studies sociology at Mt. San Antonio College in Walnut, Calif., said the new law could help him take more courses and finish sooner.\u003c/p>\n\u003cp>\u003c/p>\n\u003cp>\"Education is the only way to free from oppression - this oppression we illegals live with,\" he said. \"Education allows me to see which laws affect us and how.\"\u003c/p>\n\n\u003c/div>\u003c/p>",
