Zoe Lofgren (D-San Jose) is sponsoring three bills aimed at strengthening individual privacy amid increasingly aggressive government efforts to collect data during the course of investigations into criminal and national security threats.\u003c/p>\n\u003cp>All three bills boost privacy: insisting government agencies obtain a search warrant for electronic surveillance; barring the government from demanding surveillance “back doors” for things like smartphones; and protecting companies from government prosecution should they reveal information about the surveillance requests.\u003c/p>\n\u003cp>And once again, in greater detail:\u003c/p>\n\u003cp>\u003cstrong>The Online Communications and Geolocation Protection Act\u003c/strong>\u003c/p>\n\u003cp>The\u003ca href=\"http://lofgren.house.gov/news/documentsingle.aspx?DocumentID=397869\" target=\"_blank\"> Online Communications and Geolocation Protection Act\u003c/a> modernizes the 1986 Electronic Communications Privacy Act by requiring government agencies to obtain a search warrant based on probable cause prior to intercepting or forcing disclosure of electronic communications or geolocation data.\u003c/p>\n\u003cp>[ad fullwidth]\u003c/p>\n\u003cp>The 1986 law permits the government to get emails without a warrant after 180 days. Lofgren says that time limit is based \"on the presumption, I guess, that nobody has a privacy interest in emails stored beyond 180 days. That's absurd.\"\u003c/p>\n\u003cp>If this sounds familiar, it's because Lofgren introduced something \u003ca href=\"http://lofgren.house.gov/news/documentsingle.aspx?DocumentID=365633\" target=\"_blank\">similar \u003c/a>before, to no avail. This go-round, the bill's chances may be boosted by additional sponsors, Rep. Ted Poe (R-Texas) and Suzan DelBene (D-Washington).\u003c/p>\n\u003cp>\u003cstrong>Secure Data Act\u003cbr>\n\u003c/strong>\u003c/p>\n\u003cp>The Secure Data Act protects Americans’ privacy and data security by prohibiting surveillance agencies from requiring\u003cbr>\nsurveillance “back doors” in products and services.\u003c/p>\n\u003cp>Lofgren is sponsoring the bill with Rep. Jim Sensenbrenner (R-Wisconsin), chair of the Judiciary Subcommittee on Crime, Terrorism, Homeland Security and Oversight, and Thomas Massie (R-Kentucky), both of whom she's worked with before to limit government \u003ca href=\"http://www.allgov.com/news/top-stories/bipartisan-house-of-representatives-votes-to-limit-government-spying-on-americans-except-the-fbi-140623?news=853482\" target=\"_blank\">snooping on citizens\u003c/a>.\u003c/p>\n\u003cp>\"I think the consensus is more overwhelming than people may realize,\" she says.\u003c/p>\n\u003cp>Last year, Lofgren got an amendment tacked onto the Defense Department appropriations bill that covered some of the ground of the proposed Secure Data Act. The proposal got 293 votes, including a majority of both Democrats and Republicans in the House.\u003c/p>\n\u003cp>\"It's the overwhelming consensus in the House of Representatives that the \u003ca href=\"http://www.law.cornell.edu/constitution/fourth_amendment\" target=\"_blank\">Fourth Amendment\u003c/a> [which bars unreasonable searches and seizures] should matter ... that we don't have to destroy the Constitution to keep ourselves safe.\"\u003c/p>\n\u003cp>But the language was ultimately stripped out of the legislation by the Senate Intelligence Committee.\u003c/p>\n\u003cp>\u003cstrong>Surveillance Order Reporting Act\u003c/strong>\u003c/p>\n\u003cp>The Surveillance Order Reporting Act will enable companies to publicly report on the number of surveillance orders they receive from government agencies and how many of their users are targeted by those demands for information under the Foreign Intelligence Surveillance Act and national security letters.\u003c/p>\n\u003cp>Currently, companies are barred from disclosing even basic information about the requests they receive.\u003c/p>\n\u003cp>While Lofgren anticipates bipartisan support in both houses, it's less clear, she says, how the GOP leadership will respond. It's also uncertain she'll win backing from the Obama administration, which has been at odds with Lofgren on a number of cybersecurity fronts, favoring government flexibility in investigations over individual privacy.\u003c/p>\n\u003cp>[youtube http://www.youtube.com/watch?v=nBkz0j11Tl0]\u003c/p>\n\u003cp>\"I think presidents, including President Obama, tend to follow the lead of their intelligence community,\" Lofgren says. \"I think it's an occupational hazard. I think there have been some reforms. Lofgren says that time limit is based \"on the presumption, I guess, that nobody has a privacy interest in emails stored beyond 180 days. That's absurd.\"\u003c/p>\n\u003cp>If this sounds familiar, it's because Lofgren introduced something \u003ca href=\"http://lofgren.house.gov/news/documentsingle.aspx?DocumentID=365633\" target=\"_blank\">similar \u003c/a>before, to no avail. This go-round, the bill's chances may be boosted by additional sponsors, Rep. Ted Poe (R-Texas) and Suzan DelBene (D-Washington).\u003c/p>\n\u003cp>\u003cstrong>Secure Data Act\u003cbr>\n\u003c/strong>\u003c/p>\n\u003cp>The Secure Data Act protects Americans’ privacy and data security by prohibiting surveillance agencies from requiring\u003cbr>\nsurveillance “back doors” in products and services.\u003c/p>\n\u003cp>Lofgren is sponsoring the bill with Rep. Jim Sensenbrenner (R-Wisconsin), chair of the Judiciary Subcommittee on Crime, Terrorism, Homeland Security and Oversight, and Thomas Massie (R-Kentucky), both of whom she's worked with before to limit government \u003ca href=\"http://www.allgov.com/news/top-stories/bipartisan-house-of-representatives-votes-to-limit-government-spying-on-americans-except-the-fbi-140623?news=853482\" target=\"_blank\">snooping on citizens\u003c/a>.\u003c/p>\n\u003cp>\"I think the consensus is more overwhelming than people may realize,\" she says.\u003c/p>\n\u003cp>Last year, Lofgren got an amendment tacked onto the Defense Department appropriations bill that covered some of the ground of the proposed Secure Data Act. The proposal got 293 votes, including a majority of both Democrats and Republicans in the House.\u003c/p>\n\u003cp>\"It's the overwhelming consensus in the House of Representatives that the \u003ca href=\"http://www.law.cornell.edu/constitution/fourth_amendment\" target=\"_blank\">Fourth Amendment\u003c/a> [which bars unreasonable searches and seizures] should matter ... that we don't have to destroy the Constitution to keep ourselves safe.\"\u003c/p>\n\u003cp>But the language was ultimately stripped out of the legislation by the Senate Intelligence Committee.\u003c/p>\n\u003cp>\u003cstrong>Surveillance Order Reporting Act\u003c/strong>\u003c/p>\n\u003cp>The Surveillance Order Reporting Act will enable companies to publicly report on the number of surveillance orders they receive from government agencies and how many of their users are targeted by those demands for information under the Foreign Intelligence Surveillance Act and national security letters.\u003c/p>\n\u003cp>Currently, companies are barred from disclosing even basic information about the requests they receive.\u003c/p>\n\u003cp>While Lofgren anticipates bipartisan support in both houses, it's less clear, she says, how the GOP leadership will respond. Instead they're pointing fingers at each other. And California Democrats are leading the effort to introduce a comprehensive bill with or without GOP support.\u003c/p>\n\u003cp>\u003cstrong>GOP to Dems: Introduce our bill\u003c/strong>\u003c/p>\n\u003cp>House Republican \u003ca href=\"http://denham.house.gov/\">Jeff Denham \u003c/a>of the San Joaquin Valley said he’s ready to support a path to citizenship for an estimated 11 million undocumented people. But, according to him, Democrats are getting in their own way.\u003c/p>\n\u003cp>“It’s the Democrats that have not only written the bill but are holding onto the bill,” Denham said. “I want to support it. I want to get others to show their support. I think that will help us to get an overall comprehensive solution.”\u003c/p>\n\u003cp>[ad fullwidth]\u003c/p>\n\u003cp>House Democrats have been working on a compromise bill for years now -- ever since they lost the immigration reform campaign in 2007. Last week the group of seven who supported that bill shrank, when two Republicans withdrew their support.\u003c!--more-->\u003c/p>\n\u003cp>Denham said his friends across the aisle need to push out that bill so it has a chance of garnering new support. The GOP has introduced three bills of its own focused on enforcement and high-tech workers.\u003c/p>\n\u003cp>“That’s part of the democratic process,” Denham said. “You release a bill, you get support from the American people and you demand a hearing, you demand floor time.”\u003c/p>\n\u003cp>\u003cstrong>Dems to GOP: Agree to a vote already\u003c/strong>\u003c/p>\n\u003cp>Democrat Zoe Lofgren of San Jose said Republicans won't give any floor time.\u003c/p>\n\u003cp>She is a ranking member of the Judiciary Committee, which has to generate proposals. She said the problem isn’t a lack of bills. It’s that Republican leadership is blocking a vote.\u003c/p>\n\u003cp>“With due respect to Denham, he’s a freshman member on committees that have nothing to do with immigration,” Lofgren said. She wants him to organize senior Republican members to get the speaker to make commitments. “Because you could have the best plan in the world. If it doesn’t go to the floor for a vote, it doesn’t matter.”\u003c/p>\n\u003cp>Lofgren toiled for years over the bill that Denham wants. She says it was designed to be bipartisan with equal support from both parties. If Republicans are stepping away, she's ready to abandon it, too. “The bill was not a Democratic bill. It was a compromise bill. It’s nothing I would introduce as my first choice.”\u003c/p>\n\u003cp>Frustrated, Lofgren is moving not far left, but a bit farther left. Three months back, the Senate passed an immigration bill. Lofgren said House Democrats are introducing their own version of it in the coming days. Fellow Californian Nancy Pelosi is leading strategy talks.\u003c/p>\n\u003cp>Compared with Lofgren's old compromise bill\u003cem>, \u003c/em>the Senate version makes it easier for undocumented people to get green cards and citizenship -- and, she said, they’ve got the simple majority needed to pass it.\u003c/p>\n\u003cp>Lofgren estimates “we would have almost all the Democrats and probably in the range of 40 to 50 Republicans.”\u003c/p>\n\u003cp>House Speaker John Boehner and Majority Leader Eric Cantor say they won't allow a vote until enough Republicans are on board, that there is a supermajority in favor.\u003c/p>\n\u003cp>But they know they've got to court Latino voters for whom immigration reform is important. So, the Republican leadership released \u003ca href=\"http://www.youtube.com/watch?v=B3nR3OMNAUE\">this video\u003c/a> to celebrate Hispanic Heritage Month.\u003c/p>\n\u003cp>\u003cstrong>Momentum in California\u003c/strong>\u003c/p>\n\u003cp>Compared with other states, California has built a lot of bipartisan support. Fifteen Republicans in the state Legislature \u003ca href=\"http://arc.asm.ca.gov/member/AD44/?p=article&sid=426&id=256305\">recently wrote to Congress\u003c/a>, telling them to move already and \"put this challenge behind us.\"\u003c/p>\n\u003cp>But according to state Sen. Anthony Cannella, who signed the letter, it hasn't made a real dent.\"So far there hasn't been much of a response, but in their defense they're also thinking about Syria and the debt ceiling and all of that,\" he said.\u003c/p>\n\u003cp>A local celebrity for immigration reform, Mark Zuckerberg, doesn't sound too passionate. At \u003ca href=\"http://www.crunchbase.com/person/mark-zuckerberg\">a recent Silicon Valley event\u003c/a> organized by TechCrunch, the Facebook founder hesitated when interviewer Michael Arrington asked the question: \"So, zero chance of anything happening this year, next year?\"\u003c/p>\n\u003cp>Zuckerberg shrugged: \"I don't know. It's hard for me to say. It's not my job to get it done. It's my job to help provide support for the people who are going to do it.\"\u003c/p>\n\u003cp>Days later Zuckerberg did go to Washington to meet with House leaders. But neither Facebook nor his political action committee, FWD.us, would give details.\u003c/p>\n\u003cp>Emily Lam organizes tech CEOs with the Silicon Valley Leadership Group. She's working with farm owners, pastors, police and Latino groups on joint lobbying visits in October.\u003c/p>\n\u003cp>\"All of the advocates right now are gathering together to see how we can double down,” Lam said. “We realize the window of opportunity is closing. It really needs to happen this year. Zoe Lofgren of San Jose, the head of California's House Democratic delegation, about the letter. She had some not-totally-admiring things to say about the President and his administration.\u003c/p>\n\u003cp>Here's the edited transcript:\u003c/p>\n\u003cblockquote>\u003cp>\u003cstrong>What led to writing and releasing the letter? \u003c/strong>\u003c/p>\n\u003cp>We as a delegation and as individuals have been working on this housing crisis for a long time. We've written letters, met with the Treasury Secretary, the Housing Secretary, the head of the FHA. We've had bills, and we have gotten nowhere with the administration.\u003c/p>\n\u003cp>It's not just an academic issue. Almost every member of the California delegation goes home every week and talks face to face with constituents. And it's just an outrage what's happened. The banks are just running roughshod over the people that we represent and we're furious about it.\u003c/p>\n\u003cp>[The delegation] said 'we've had it.' If we have to go public and say 'do something,' we'll do it. Maybe finally we'll get the president's attention. I think the \u003ca href=\"http://www.npr.org/2011/10/24/141663203/obama-to-announce-refinancing-initiative\">step on refinancing\u003c/a> that was bullet point No. 1 in our letter is a step forward. It doesn’t help the foreclosure crisis and we had other recommendations. I hope this isn't all the president is going to do. But do you think he's getting conflicting advice? \u003c/strong>\u003c/p>\n\u003cp>I don’t know, but we met with Secretary Geithner and it was not an impressive meeting.
