"bio": "• I write and edit stories about how Silicon Valley power and policies shape everyday life in California. I’m also passionate about making Bay Area history and culture more accessible to a broad public. • I’ve been a journalist for most of my life, starting in high school with The Franklin Press in Los Angeles, where I grew up. While earning my first degree in English at UC Berkeley, I got my start in public radio at KALX-FM. After completing a second degree in journalism at Cal, I landed my first professional job at Marketplace, then moved on to KPCC (now LAist), and then KQED, where I hosted The California Report for more than seven years. • My reporting has appeared on NPR, The World, WBUR’s \u003ci>Here & Now\u003c/i>, and the BBC. I also guest host for KQED’s \u003ci>Forum\u003c/i>, as well as the Commonwealth Club in San Francisco. • I speak periodically on media, democracy and technology issues, and do voiceover work for documentaries and educational video projects. • Outside of the studio, you'll find me hiking Bay Area trails and whipping up Insta-ready meals in my kitchen. • I do not accept gifts, money, or favors from anyone connected to my reporting, I don't pay people for information, and I do not support or donate to political causes. • I strive to treat the people I report on with fairness, honesty, and respect. I also recognize there are often multiple sides to a story and work to verify information through multiple sources and documentation. If I get something wrong, I correct it.",

The companies would then be free to sell those credits on the new carbon trading exchange. \u003c/p>\n\u003cp>\u003cem>ORIGINAL POST\u003c/em>\u003cbr>\nThe California Air Resources Board is \u003ca href=\"http://www.cal-span.org/State_Webcast/CARB/stream_index.htm\">\u003cstrong>meeting\u003c/strong>\u003c/a> today and tomorrow and is widely expected to \u003ca href=\"http://www.mercurynews.com/business/ci_16868556\">adopt proposed regulations\u003c/a> from its staff that include a cap-and-trade carbon-trading system. By day’s end Thursday, the state will likely have the nation’s first system that covers more than electric utilities.\u003c/p>\n\u003cp>If the California Air Resources Board formally adopts a set of proposed regulations from its staff, as expected, then starting in early 2012, major emitters of greenhouse gases will come under the program. That ‘s anything that puts out more than 25,000 tonnes of C02 per year; we’re talking power plants, cement kilns, glass factories and of course, oil refineries, where carbon emissions are measured in the millions of metric tons per year.\u003c/p>\n\u003cp>In 2015 the program will expand and follow these oil and gas products downstream; that means producers will have to account–and eventually pay for–not just the emissions from drilling and refining, but for that carbon produced when the fuel actually gets burned in trains and planes and automobiles.\u003c/p>\n\u003cp>I say “eventually” because the pay-to-play part doesn’t really kick in right away. At first, the state will give away 90% of emissions permits. Can you summarize the plan, including the cap and trade component?\u003c/p>\n\u003cp>[ad fullwidth]\u003c/p>\n\u003cp>CRAIG MILLER\u003cbr>\nThe CARB staff is recommending that the state start meting out “allowances” (permits to emit carbon) in February of 2012, starting with electrical utilities and “large industrial” emitters, like oil refineries and cement plants. At first, 90% of the permits will be given away, as a nod to the current tough economic environment. In later years, the state will auction off a portion of the permits.\u003c/p>\n\u003cp>Each year the cap on total emissions shrinks a bit to attain the CO2 reduction goals of AB 32. The whole thing is up for public comment now. Board approval is expected at the December 16th meeting. Here’s a downloadable PDF overview of the whole program.\u003c/p>\n\u003cp>QUESTION\u003cbr>\nIn the San Jose Mercury News, both the Natural Resources Defense Council and industry officials reported they were pleased with the rules. So has CARB hit that sweet spot where both sides are happy? What am I missing here?\u003c/p>\n\u003cp>CRAIG MILLER\u003cbr>\nFunny you should put it that way. “Sweet spot” is exactly the term used by Jamie Fine, a policy analyst with the Environmental Defense Fund in Sacramento. He told me he thinks the state has done a good job of finding that happy zone that serves the twin goals of achieving eventual carbon reductions and protecting the state’s economy from an ill-timed hit.\u003c/p>\n\u003cp>It’s true that many environmentalists were pushing for a “100% auction” of permits but CARB staffers have been saying for months that that wasn’t a realistic way to start. Fine figures that more than half the permits will be auctioned by 2015 and he’s happy with that.\u003c/p>\n\u003cp>QUESTION\u003cbr>\nDo you think there was some political motivation to releasing the rules the Friday before the vote on Prop 23?\u003c/p>\n\u003cp>CRAIG MILLER\u003cbr>\nSeems logical, as there was a chance there to show that full implementation of AB 32 wouldn’t be a job killer. But they also needed 45 days for public comment before the December board meeting.\u003c/p>\n\u003cp>QUESTION\u003cbr>\nWhat exactly did Valero and Tesoro have at stake so that they bankrolled Prop 23? And why did the really prominent big oil companies stay out of the fight?\u003c/p>\n\u003cp>CRAIG MILLER\u003cbr>\nFor oil companies with major refining operations in California, tens of millions of dollars per year were on the line, in potential permit fees and upgrades to facilities. Valero, the nation’s largest refiner and biggest donor to Prop 23, estimated that AB 32 would cost the company $75 million. Both Valero and Tesoro have refineries in California, including Tesoro’s largest. We’ve mapped the state’s biggest industrial carbon emitters:\u003c/p>\n\u003cp>I’m not an oil industry analyst but the major oil companies can use profits from their “upstream” operations—their crude oil fields, basically—to offset the cost of AB 32. Valero & Tesoro are just refiners and are seeing their margins squeezed more than the big, vertically integrated players. It’s worth noting that Occidental, an LA-based oil company, was also a large donor to Prop 23.\u003c/p>\n\u003cp>QUESTION\u003cbr>\nReports indicated that a lot of money was switched from going to Prop 23 to Prop 26 when it became clear 23 would not pass. How will Prop 26 impact AB 32? Will the state find it hard or impossible to institute fees necessary to implement the new rules?\u003c/p>\n\u003cp>CRAIG MILLER\u003cbr>\nWe don’t know yet. But toward the end of the campaign, it was “the elephant in the room” that the No-on-23 people weren’t really talking about. CARB’s position is that Prop 26—having passed—will not affect any fees authorized by AB 32, which passed in 2006. Others say it’s not that clear-cut. Stay tuned.\u003c/p>\n\u003cp>QUESTION\u003cbr>\nAny other important issues related to AB 32?\u003c/p>\n\u003cp>[ad floatright]\u003c/p>\n\u003cp>CRAIG MILLER\u003cbr>\nUnsettled is exactly what will happen with the Western Climate Initiative, the nascent attempt at a regional carbon trading partnership between California and several other states and Canadian provinces. Recently it has seemed that only New Mexico and Quebec were really ready to move forward with WCI. Arizona has pulled out of the cap-and-trade plan. Other states are in limbo, still participating on paper but without the necessary enabling legislation. We may find out more from this week’s climate “summit” that Governor Schwarzenegger is hosting in Davis.\u003c/p>\n\n",

He told me he thinks the state has done a good job of finding that happy zone that serves the twin goals of achieving eventual carbon reductions and protecting the state’s economy from an ill-timed hit.\u003c/p>\n\u003cp>It’s true that many environmentalists were pushing for a “100% auction” of permits but CARB staffers have been saying for months that that wasn’t a realistic way to start. Fine figures that more than half the permits will be auctioned by 2015 and he’s happy with that.\u003c/p>\n\u003cp>QUESTION\u003cbr>\nDo you think there was some political motivation to releasing the rules the Friday before the vote on Prop 23?\u003c/p>\n\u003cp>CRAIG MILLER\u003cbr>\nSeems logical, as there was a chance there to show that full implementation of AB 32 wouldn’t be a job killer. But they also needed 45 days for public comment before the December board meeting.\u003c/p>\n\u003cp>QUESTION\u003cbr>\nWhat exactly did Valero and Tesoro have at stake so that they bankrolled Prop 23? And why did the really prominent big oil companies stay out of the fight?\u003c/p>\n\u003cp>CRAIG MILLER\u003cbr>\nFor oil companies with major refining operations in California, tens of millions of dollars per year were on the line, in potential permit fees and upgrades to facilities. Valero, the nation’s largest refiner and biggest donor to Prop 23, estimated that AB 32 would cost the company $75 million. Both Valero and Tesoro have refineries in California, including Tesoro’s largest. We’ve mapped the state’s biggest industrial carbon emitters:\u003c/p>\n\u003cp>I’m not an oil industry analyst but the major oil companies can use profits from their “upstream” operations—their crude oil fields, basically—to offset the cost of AB 32. Valero & Tesoro are just refiners and are seeing their margins squeezed more than the big, vertically integrated players. It’s worth noting that Occidental, an LA-based oil company, was also a large donor to Prop 23.\u003c/p>\n\u003cp>QUESTION\u003cbr>\nReports indicated that a lot of money was switched from going to Prop 23 to Prop 26 when it became clear 23 would not pass. How will Prop 26 impact AB 32? Will the state find it hard or impossible to institute fees necessary to implement the new rules?\u003c/p>\n\u003cp>CRAIG MILLER\u003cbr>\nWe don’t know yet. But toward the end of the campaign, it was “the elephant in the room” that the No-on-23 people weren’t really talking about. CARB’s position is that Prop 26—having passed—will not affect any fees authorized by AB 32, which passed in 2006. Others say it’s not that clear-cut. The federal investigators say that \"no physical evidence suggests that a pre-existing leak occurred in the ruptured pipe pieces.\"\n\u003c/p>\u003c/blockquote>\n\u003cp>The \u003ca href=\"http://online.wsj.com/article/SB10001424052748704694004576019722409940728.html\">Wall Street Journal\u003c/a> puts it this way:\u003c/p>\n\u003cblockquote>\u003cp>Pieces of a pipeline involved in a September explosion near San Francisco show unusual variations in the welds, the National Transportation Safety Board said Tuesday.\u003c/p>\n\u003cp>The board also noted discrepancies between utility records concerning the kind of pipe used and what investigators pulled from the ground after the accident.\u003c/p>\u003c/blockquote>\n\u003cp>\u003c!--more-->\u003c/p>\n\u003cp>\u003cem>Earlier post\u003c/em>:\u003c/p>\n\u003cp>[ad fullwidth]\u003c/p>\n\u003cp>The NTSB has released an \u003ca href=\"http://www.ntsb.gov/Pressrel/2010/101214.html\">\u003cstrong>update\u003c/strong>\u003c/a> of its \u003ca href=\"http://www.mercurynews.com/news/ci_16332385\">initial investigation\u003c/a> into the \u003ca href=\"http://www.kqed.org/news/sanbruno.jsp\">San Bruno gas pipeline explosion\u003c/a> that killed eight people and destroyed dozens of homes in a subsequent fire. \u003c/p>\n\u003cp>\u003c/p>\n\u003cbr>\nThe information provided is rather technical and not necessarily easy to follow, but one thing is clear: Not only does the agency not yet know what caused the fatal event, it may not come to a final conclusion for some time.\n\u003cblockquote>\u003cp>The investigation is still in an early phase and there is much factual information to be developed before the Safety Board is positioned to determine the probable cause of the accident.\u003c/p>\u003c/blockquote>\n\u003cp>Today's release focuses on the examination of ruptured pipe pieces. Here is the crux of the findings:\u003c/p>\n\u003cblockquote>\u003cp>Investigators found that while the longitudinal seams on some of the pipe segments were fusion-welded from both inside and outside the pipe, some were fusion-welded only from the outside of the pipe. In order to understand this variance, investigators are in the process of researching pipe welding standards and practices in effect at the time the pipeline was installed in 1956.\u003c/p>\n\u003cp>The outer surfaces of the ruptured pipe pieces revealed no evidence of external corrosion. No dents, gouges, or other physical indications consistent with excavation damage were observed. Here is the crux of the findings:\u003c/p>\n\u003cblockquote>\u003cp>Investigators found that while the longitudinal seams on some of the pipe segments were fusion-welded from both inside and outside the pipe, some were fusion-welded only from the outside of the pipe. In order to understand this variance, investigators are in the process of researching pipe welding standards and practices in effect at the time the pipeline was installed in 1956.\u003c/p>\n\u003cp>The outer surfaces of the ruptured pipe pieces revealed no evidence of external corrosion. No dents, gouges, or other physical indications consistent with excavation damage were observed. "content": "\u003cp>A rule of thumb whenever you hear about something called a \"tax deal\": the devil is always in the details. And \"tax deals\" are always amazingly complex. So, the agreement we've been hearing about all week, the one so easily summarized as President Obama's acceptance of a continuation of the Bush tax cuts (for everyone, including the very wealthy) in exchange for the GOP's going along with extended unemployment benefits, is full of little surprises. \u003c/p>\n\u003cp>Here's a surprise that alarms Lyndon Rive, the founder and CEO of \u003ca href=\"http://www.solarcity.com/media-center/company-profile.aspx\" target=\"_blank\">SolarCity\u003c/a>, a big solar power seller and installer based in Foster City. Rive's story is this: The tax deal includes a major business tax break: a two-year provision that allows companies to take accelerated depreciation—100 percent of the value of capitalized assets. In essence, that will allow companies to cancel out their tax liabilities for the coming years. Rive argues that while that's \"a fantastic thing\" for U.S. business as a whole, it has a bad and completely unintended consequence for the solar industry. \u003c/p>\n\u003cp>\u003c!--more-->\u003c/p>\n\u003cp>Rive explains that the carrot that's driving the massive investment in solar and other renewable energy right now is the big federal incentive program for purchasers of solar systems (and wind and small hydro systems, too). One part of the program is a tax credit equal to 30 percent of the purchaser's investment. Side-by-side with that program is a 30 percent Treasury cash grant tax called the \u003ca href=\"http://www.treasury.gov/initiatives/recovery/Pages/1603.aspx\" target=\"_blank\">1603 program\u003c/a> that's part of the Obama administration's stimulus program).\u003c/p>\n\u003cp>Here's where the problem lies, according to Rive: by far the biggest investors in solar systems are large financial institutions: Wells Fargo, U.S. Bank, JPMorgan Chase, and Morgan Stanley among them. The banks purchase the systems and essentially lease them to end users like homeowners and small business, whose only ongoing payments are for the electricity the systems provide (end users also are credited for any surplus power generated and fed back into the grid). This arrangement allows the investors to get the benefits of the big federal tax credits or 1603 grants. However, with a 100 percent immediate depreciation of capitalized assets available, the banks and other investors have the ability to immediately zero out their tax liabilities. Since they no longer have any \"tax appetite\"—the term Rive repeatedly used for their need to find a strategy to reduce their tax bills--their incentive to buy solar systems for the 30 percent tax credit will go away, at least in the short term (you can't take a credit if your tax bill is zero). He said the fix is to continue the 1603 Treasury cash grant, which will give the banks and other investors an incentive to continue to buy renewable energy systems.\u003c/p>\n\u003cp>[ad fullwidth]\u003c/p>\n\u003cp>Rive said that if this feature of the tax deal is not fixed, the effect on the industry would be far worse for solar and other renewable sectors than the financial industry meltdown two years ago. Because the renewable power industry relies so heavily on the banks for growth, it ground to a standstill and was only restarted by the 1603 program. (How bad was the pullback? Rive said Solar City had 380 employees when the meltdown hit; demand shrank so abruptly that the company laid off about 100 employees; since the advent of the stimulus package and the financial industry recovery, the sector has boomed, and Solar City's workforce now stands at 930). \u003c/p>\n\u003cp>We've got calls out to renewable industry trade groups, to several solar companies, and to other industry analysts. The \u003ca href=\"http://www.seia.org/\" target=\"_blank\">Solar Energy Industries Association \u003c/a>in Washington is working on an analysis of the new tax legislation, and we hope to have more on that later today. \u003c/p>\n\u003cp>\u003c/p>\n\u003cp>In the meantime, our researches have disclosed that the solar industry's concern about the 1603 program pre-dates this week's tax deal. The program—remember, it's part of the 2009 stimulus package— is set to expire December 31. So the renewable sector has been lobbying since the beginning of the year to get it extended. The tax deal, with its 100 percent depreciation provision, has merely accelerated the concern for some. \u003c/p>\n\n",

"content": "\u003cdiv class=\"post-body\">\u003cp>\u003cp>A rule of thumb whenever you hear about something called a \"tax deal\": the devil is always in the details. And \"tax deals\" are always amazingly complex. So, the agreement we've been hearing about all week, the one so easily summarized as President Obama's acceptance of a continuation of the Bush tax cuts (for everyone, including the very wealthy) in exchange for the GOP's going along with extended unemployment benefits, is full of little surprises. \u003c/p>\n\u003cp>Here's a surprise that alarms Lyndon Rive, the founder and CEO of \u003ca href=\"http://www.solarcity.com/media-center/company-profile.aspx\" target=\"_blank\">SolarCity\u003c/a>, a big solar power seller and installer based in Foster City. Rive's story is this: The tax deal includes a major business tax break: a two-year provision that allows companies to take accelerated depreciation—100 percent of the value of capitalized assets. In essence, that will allow companies to cancel out their tax liabilities for the coming years. Rive argues that while that's \"a fantastic thing\" for U.S. business as a whole, it has a bad and completely unintended consequence for the solar industry. \u003c/p>\n\u003cp>\u003c!--more-->\u003c/p>\n\u003cp>Rive explains that the carrot that's driving the massive investment in solar and other renewable energy right now is the big federal incentive program for purchasers of solar systems (and wind and small hydro systems, too). One part of the program is a tax credit equal to 30 percent of the purchaser's investment. Side-by-side with that program is a 30 percent Treasury cash grant tax called the \u003ca href=\"http://www.treasury.gov/initiatives/recovery/Pages/1603.aspx\" target=\"_blank\">1603 program\u003c/a> that's part of the Obama administration's stimulus program).\u003c/p>\n\u003cp>Here's where the problem lies, according to Rive: by far the biggest investors in solar systems are large financial institutions: Wells Fargo, U.S. Bank, JPMorgan Chase, and Morgan Stanley among them. The banks purchase the systems and essentially lease them to end users like homeowners and small business, whose only ongoing payments are for the electricity the systems provide (end users also are credited for any surplus power generated and fed back into the grid). This arrangement allows the investors to get the benefits of the big federal tax credits or 1603 grants. However, with a 100 percent immediate depreciation of capitalized assets available, the banks and other investors have the ability to immediately zero out their tax liabilities. Since they no longer have any \"tax appetite\"—the term Rive repeatedly used for their need to find a strategy to reduce their tax bills--their incentive to buy solar systems for the 30 percent tax credit will go away, at least in the short term (you can't take a credit if your tax bill is zero). He said the fix is to continue the 1603 Treasury cash grant, which will give the banks and other investors an incentive to continue to buy renewable energy systems.\u003c/p>\n\u003cp>\u003c/p>\u003c/div>",

"content": "\u003cdiv class=\"post-body\">\u003cp>\u003c/p>\n\u003cp>Rive said that if this feature of the tax deal is not fixed, the effect on the industry would be far worse for solar and other renewable sectors than the financial industry meltdown two years ago. Because the renewable power industry relies so heavily on the banks for growth, it ground to a standstill and was only restarted by the 1603 program. (How bad was the pullback? Rive said Solar City had 380 employees when the meltdown hit; demand shrank so abruptly that the company laid off about 100 employees; since the advent of the stimulus package and the financial industry recovery, the sector has boomed, and Solar City's workforce now stands at 930). \u003c/p>\n\u003cp>We've got calls out to renewable industry trade groups, to several solar companies, and to other industry analysts. The \u003ca href=\"http://www.seia.org/\" target=\"_blank\">Solar Energy Industries Association \u003c/a>in Washington is working on an analysis of the new tax legislation, and we hope to have more on that later today. \u003c/p>\n\u003cp>\u003c/p>\n\u003cp>In the meantime, our researches have disclosed that the solar industry's concern about the 1603 program pre-dates this week's tax deal. The program—remember, it's part of the 2009 stimulus package— is set to expire December 31. So the renewable sector has been lobbying since the beginning of the year to get it extended. The tax deal, with its 100 percent depreciation provision, has merely accelerated the concern for some. \u003c/p>\n\n\u003c/div>\u003c/p>",
