"content": "\u003cp>The Federal Bureau of Prisons is pushing back on a judge’s order delaying the mass transfer of hundreds of incarcerated women at FCI Dublin, days after the agency’s director publicly announced it was shutting down the prison.\u003c/p>\n\u003cp>In a brief filed Tuesday, government attorneys said the court’s order, as well as the interpretation of that order by the recently appointed special master, have significantly delayed the transfer of women to other facilities.\u003c/p>\n\u003cp>“The logistical details involved with the mass transfer of all [incarcerated people] at a particular facility cannot be changed on the fly,” the government’s brief reads. “Extensive resources and employee hours have already been invested in the move.”\u003c/p>\n\u003cp>\u003cb>Catch up fast: \u003c/b>\u003ca href=\"https://www.kqed.org/news/11983151/infamous-womens-prison-plagued-by-sex-abuse-closes\">The federal Bureau of Prisons announced Monday it would close FCI Dublin\u003c/a> after years of staff sexual misconduct allegations, multiple criminal indictments and dozens of lawsuits alleging sexual assault, harassment and retaliation.\u003c/p>\n\u003cp>In a statement, BOP Director Colette S. Peters said that the agency had provided tremendous resources to address the culture at FCI Dublin. “Despite these steps and resources, we have determined that FCI Dublin is not meeting expected standards and that the best course of action is to close the facility,” she added.\u003c/p>\n\u003cp>[ad fullwidth]\u003c/p>\n\u003cp>[aside postID=\"news_11979936,news_11980960,news_11978878\" label=\"Related Stories\"]Within hours of the announcement, U.S. District Judge Yvonne Gonzalez Rogers issued an order requiring prison officials to update casework for all inmates to ensure they are sent to the correct location — another BOP facility, home confinement or a halfway house, or if they should be granted compassionate release. “The result of these case reviews and transfer designations shall be reviewed with the Special Master prior to transfer,” the order reads. Another document detailing additional guidance to BOP on the transfers was filed under seal.\u003c/p>\n\u003cp>In the Tuesday brief, government attorneys wrote that the special master, Wendy Still, had told FCI Dublin’s interim warden, Nancy McKinney, that she interpreted the court’s order as authorizing her to have each incarcerated person medically reviewed by her staff and a BOP doctor before approving the transfer. “These procedures — above what BOP requires — are significantly delaying the transfer process,” attorneys wrote, arguing that the court does not have the authority to decide when inmates in its custody should be transferred.\u003c/p>\n\u003cp>“It is beyond question that transfer of inmates falls within the exclusive authority of the BOP, and it is not subject to judicial review,” the brief reads.\u003c/p>\n\u003cp>\u003cb>How many people have been transferred so far?\u003c/b> It’s unclear. A BOP spokesperson declined to comment beyond Peters’ initial statement on the closure — which said the timing of transfers would not be shared — citing “safety and security reasons.”\u003c/p>\n\u003cp>In an interview with KQED on Tuesday, an incarcerated woman described a chaotic scene at the prison as officials attempted to transfer roughly 600 or so people.\u003c/p>\n\u003cp>Ashley Castillo said she and other prisoners learned about the closure on Monday morning through news reports. They were subsequently told 100 people would be transferred per day, with the first group of prisoners — including Castillo — leaving that same day. As the women were given a green bag to fill with their belongings, they noticed officers from other BOP facilities had replaced the prison’s usual staff, Castillo said. Some women got on a bus to leave but ultimately returned to the prison, she added.\u003c/p>\n\u003cp>“They packed people out and they even dressed them out, and they let them board the bus,” Castillo said. “And then at the end, like around three o’clock, they brought them back. They dressed them out again, gave them their uniforms again, and they said you guys are not going nowhere.”\u003c/p>\n\u003cp>Still, who Gonzalez Rogers appointed barely a week and a half ago, and is tasked with overseeing a series of reforms at FCI Dublin, was at the prison on Monday and Tuesday communicating with prisoners, according to Castillo.\u003c/p>\n\u003cp>“We were all going crazy not knowing what was going on. [Still] said, ‘Don’t worry, I’m talking to the judge right now, and I’m trying to put a stop to it because you guys are not medically cleared to go anywhere,’” Castillo recalled, adding that the uncertainty of the announcement had created confusion and distress among women at the prison who were frantically trying to get ahold of their families.\u003c/p>\n\u003cp>\u003cb>The latest: \u003c/b>Two hearings were held this morning that were closed to the public. Shortly after, Gonzalez Rogers issued another order, under seal, with further guidance on the transfers. A BOP spokesperson declined to comment beyond Peters’ initial statement on the closure — which said the timing of transfers would not be shared — citing “safety and security reasons.”\u003c/p>\n\u003cp>In an interview with KQED on Tuesday, an incarcerated woman described a chaotic scene at the prison as officials attempted to transfer roughly 600 or so people.\u003c/p>\n\u003cp>Ashley Castillo said she and other prisoners learned about the closure on Monday morning through news reports. They were subsequently told 100 people would be transferred per day, with the first group of prisoners — including Castillo — leaving that same day. As the women were given a green bag to fill with their belongings, they noticed officers from other BOP facilities had replaced the prison’s usual staff, Castillo said. Some women got on a bus to leave but ultimately returned to the prison, she added.\u003c/p>\n\u003cp>“They packed people out and they even dressed them out, and they let them board the bus,” Castillo said. “And then at the end, like around three o’clock, they brought them back. They dressed them out again, gave them their uniforms again, and they said you guys are not going nowhere.”\u003c/p>\n\u003cp>Still, who Gonzalez Rogers appointed barely a week and a half ago, and is tasked with overseeing a series of reforms at FCI Dublin, was at the prison on Monday and Tuesday communicating with prisoners, according to Castillo.\u003c/p>\n\u003cp>“We were all going crazy not knowing what was going on. The warden, an associate warden and a captain were reportedly removed from the facility, said the person, who was not authorized to speak publicly and did so on the condition of anonymity.\u003c/p>\n\u003cp>FBI agents could be seen carrying boxes out of the prison, which has been known as the “rape club” because of years of rampant staff-on-inmate abuse. We have a lot of questions and a lot of concerns about our clients who are still at this facility.”\u003c/p>\n\u003cp>Janssen said there are also concerns about how the prison is currently functioning.\u003c/p>\n\u003cp>A spokesperson with the federal Bureau of Prisons told KQED that a new interim warden has been assigned at the facility effective immediately:\u003c/p>\n\u003cp>“Consistent with unprecedented and ongoing actions by FBOP leadership to create a positive change in the culture at FCI Dublin, recent developments have necessitated new executive employees be installed at the institution. This new team has been charged with developing a plan for the future of the facility,” the BOP stated.\u003c/p>\n\u003cp>Monday’s search came days after \u003ca href=\"https://www.kqed.org/news/11978712/infamous-east-bay-womens-prison-hit-with-12-additional-sexual-assault-lawsuits\">a new wave of civil lawsuits alleging abuse at FCI Dublin\u003c/a> and \u003ca href=\"https://www.kqed.org/news/11971511/judge-considers-federal-oversight-for-dublin-womens-prison-notorious-for-sexual-abuse\">as a federal judge weighs appointing a special master to oversee the prison’s operations\u003c/a>. The new claims filed last week bring the total number of lawsuits facing FCI Dublin to 63. It’s the latest cloud over the low-security facility about 21 miles east of Oakland.[pullquote size='medium' align='right' citation=\"Bureau of Prisons\"]‘Consistent with unprecedented and ongoing actions by FBOP leadership to create a positive change in the culture at FCI Dublin, recent developments have necessitated new executive employees be installed at the institution. This new team has been charged with developing a plan for the future of the facility.’[/pullquote]\u003ca href=\"https://apnews.com/article/prisons-california-united-states-sexual-abuse-only-on-ap-d321ae51fe93dfd9d6e5754383a95801\">An AP investigation in 2021\u003c/a> found a culture of abuse and cover-ups that had persisted for years at the prison, which has more than 650 inmates. That reporting led to increased scrutiny from Congress and pledges from the Bureau of Prisons that it would fix problems and change the culture at the prison.\u003c/p>\n\u003cp>At least eight employees have been charged with sexually abusing inmates. Five have pleaded guilty. Two were convicted at trial. Another case is pending.\u003c/p>\n\u003cp>All sexual activity between a prison worker and an inmate is illegal. Correctional employees enjoy substantial power over inmates, controlling every aspect of their lives from mealtime to lights out, and there is no scenario in which an inmate can give consent.\u003c/p>\n\u003cp>The scandal has been one of many troubles plaguing the BOP, which is also beset by rampant \u003ca href=\"https://apnews.com/article/coronavirus-united-states-prisons-staff-shortages-health-dba13f1c6368392be2bc5e7375170a78\">staffing shortages\u003c/a>, suicides and security breaches.\u003c/p>\n\u003cp>Former Dublin warden Ray Garcia was \u003ca href=\"https://apnews.com/article/prisons-california-sexual-abuse-us-federal-bureau-of-investigation-93a168903fbeaed61f72fb9088e02dd4\">convicted in 2022 of molesting inmates\u003c/a> and forcing them to pose naked in their cells. Prosecutors say he tried to keep his victims quiet with promises that he’d help them get early release and told one victim he was close friends with a prison official responsible for investigating staff misconduct and couldn’t be fired.\u003c/p>\n\u003cp>The FBI arrested Garcia in September 2021, months after \u003ca href=\"https://apnews.com/article/government-and-politics-prisons-california-bf66f02f8d21137461497d26c38c6ac5\">questioning him at the prison\u003c/a> and searching his office and vehicle. He is serving a six-year prison sentence.[aside label=\"related coverage\" tag=\"fci-dublin\"]Testifying on his own behalf, Garcia conceded that he had made mistakes but claimed that some of his alleged wrongdoing — like taking pictures of naked inmates — was done as part of his official duties to document violations of prison policy.\u003c/p>\n\u003cp>Prosecutors countered by calling a prison lieutenant who said he’s never seen a case where it was appropriate for an employee to take photos of a nude inmate.\u003c/p>\n\u003cp>Among the other employees accused of sexual abuse were former chaplain James Theodore Highhouse, who was sentenced to seven years in prison after pleading guilty to \u003ca href=\"https://apnews.com/article/sexual-abuse-arrests-prisons-1f6def993dee7621a995e1b852dde9c5\">abusing an inmate\u003c/a> in his chapel office and lying to authorities, and ex-safety administrator John Russell Bellhouse, who was convicted last June of \u003ca href=\"https://apnews.com/article/coronavirus-pandemic-college-admissions-health-arrests-prisons-3c90285b68758035990cf29d24f3826d\">sexually abusing two inmates\u003c/a>.\u003c/p>\n\u003cp>Prosecutors said Bellhouse “began to express an interest in a particular female inmate and started calling the inmate his ‘girlfriend’” in 2020. They said he inappropriately touched the woman and that she performed oral sex on Bellhouse twice in the prison’s safety office. He was sentenced to more than five years in prison.\u003c/p>\n\u003cp>Since Garcia’s removal as warden, new officials have promised to turn around the scandal-ridden prison. U.S. District Judge Yvonne Gonzalez Rogers is expected to decide whether to \u003ca href=\"https://www.kqed.org/news/11972346/federal-oversight-of-dublin-womens-prison-highly-doubtful-despite-ongoing-abuse-allegations\">order the changes\u003c/a> in the coming weeks.\u003c/p>\n\u003cp>“This horrific abuse is continuing to happen right here in the Bay Area even during and after officers being convicted,” said Emily Shapiro, a member of California Coalition for Women Prisoners, in a press statement on Friday. “The experiences of these 12 additional survivors speak to the fact that the abuse is systemic, that officers weaponize solitary confinement, immigration status, and write-ups to coerce people in Dublin, and that the culture of the BOP has not changed in any true or lasting way.”\u003c/p>\n\u003cp>\u003c/p>\n\u003cp>\u003cem>KQED’s Alex Hall contributed to this report.\u003c/em>\u003c/p>\n\n\u003c/div>\u003c/p>",
